The current contract expires on October 31, 2020. The solicitation was publized two times however; did not receive acceptable competitive quotes. A short term contract is needed to provide time to award a long term contract. Description of Supplies/Services Required to Meet the Agency s Needs: The fixed price contract is to provide SAVAHCS perfusion services. Cardio Perfusion services are vital to the surgery department s mission. It is critical that these services do not lapse. On average there is a need for these services three times in a 24-hour period. They are requesting a 12 month contract for services. The estimated dollar amount for this order is $288,119.16 for the total 12-month period. Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3; ( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 ( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5; ( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6; ( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Failure to execute this action could result in serious jeopardy to SAVAHCS major mission of Veterans healthcare and safety and therefore, the SAVAHCS would be seriously injured unless VA ensures continuation of services in accordance with this justification. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The requirement cannot be solicited because urgent and compelling nature. The current contract expires on October 31, 2020 which is an extension using FAR 52.217-8 Option to Extend Services. Awarding to the incumbent will be in the best interest of the government. The solicitation was publized two times however; did not receive acceptable competitive quotes. A short term contract is needed to provide time to award a long term contract. An award notice for each contract action awarded utilizing this authority will be publicized within 10 days after award. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The CO has determined the price fair and reasonable based on historical pricing received from the incumbent contractor. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was completed and determined there were three SDVOSB s that could provide services. Upon receipt of the quotes, the quotes were determined unacceptable and could not be awarded. It is critical that services continue without any lapse in services. Any Other Facts Supporting the Use of Other than Full and Open Competition: This requirement was not competed due to urgent and compelling matters. Due to the two month credentialing timeframe of employees, a new solicitation and award can not be completed prior to the expiration of the existing contract. Therefore, an award will be made to the incumbent, short term, until a long term award can be completed. Valuable market research will be conducted to determine qualified contractors that can fulfill this requirement.
