- THE U.S. NUCLEAR REGULATORY COMMISSION (NRC) is issuing this Sources Sought Notice as a means to supplement its market research or as a market survey to determine the availability of potential qualified vendors that are free of conflicts of interest and have the technical capability to provide all management, supervision, administration, and labor for expert legal services in support of the NRC�s Office of the Inspector General (OIG). The NRC�s OIG is located at the NRC headquarters complex in Rockville, Maryland. The NRC OIG also provides services for the Defense Nuclear Facilities Safety Board (DNFSB), and OIG may require expert legal services in connection with that work. The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 541110. THERE IS NO SOLICITATION AT THIS TIME.� This request for sources and vendor information does not constitute a request for proposal; submission of any information in response to this market survey is purely voluntary; the Government assumes no financial responsibility for any costs incurred.� The NRC seeks to identify established law firms that meet the following criteria: Has partner and associate level attorneys in good standing in the state bar of any State, the District of Columbia, or Federal territory and admitted to practice in Federal District and Federal Appeals Courts. � Has experience working with a Federal OIG headed by a presidentially-appointed IG. Has demonstrated experience with equal employment opportunity (EEO), sexual harassment (SH), and whistleblower (WB) matters including case evaluations, investigations, and recommendations for multiple management actions and litigation before the Merit Systems Protection Board (MSPB), Equal Employment Opportunity Commission (EEOC), Office of Special Counsel (OSC) and other fora as well as coordination with the Department of Justice or NRC General Counsel for Federal court action both at the trial and appellate level. Has partner and associate attorneys that can immediately perform at the expert level, with significant experience in Federal employee EEO/SH/WB/OSC matters involving audit and investigative (law enforcement) components in Inspector General offices.� � Has partners with significant experience serving as an advisor and representative to Federal employers in Federal employment cases. Has significant experience with representation before the MSPB, EEOC and OSC as well as other administrative tribunals; and arbitration or mediation and Federal court in complex cases involving professional level employees. �This experience should include demonstrated ability to provide timely and expert services including cases involving GS-1811series criminal investigators, experience and knowledge of Federal investigative quality standards, Brady/Giglio requirements, and NRC/OIG practices and procedures. Has experience working with government attorneys as second chair in hearings and proceedings; representing senior Federal officials and representing law enforcement offices; and experience with time sensitive personnel, employment, EEO/SH/WB/OSC matters including case evaluations.�
