- VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under $250K VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID:36C250-20-AP-4296 Contracting Activity: Department of Veterans Affairs, VISN10, Cleveland VA Medical Center Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This activity proposes to solicit with Motek Medical BV using sole source procurement under NACIS Code 541712 to provide all necessary labor, management, supervision, technical skills, quality control, materials, software, and equipment necessary to provide one year of standard maintenance and support services beginning 10/1/2020-9/30/2021 for full service level maintenance agreement, is contracting to provide one year D-Flow Software Maintenance agreement for the Virtual Reality (V-Gait) system located in room BE213-B. This system is proprietary in nature and must be handled by Motek Medical. The estimated total amount if $28,000.00 Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Louis Stokes Cleveland Department of Veterans Affairs Healthcare System is requesting VISN 10 Contracting Activity to enter sole source procurement with Motek Medical. to complete the above stated service agreement. This request is being entered as a sole source because of the proprietary nature of the equipment. Motek Medical holds proprietary rights to software and is the only contractor that can provide maintenance hardware because it must be compatible with the current hardware/ software. This request is being entered as a sole source because of the proprietary nature of the equipment and associated software. Description of market research conducted and results or statement why it was not conducted: FAR 13.106-1(b)(1)(i): Urgency, Exclusive Licensing, Brand Name- VIP database identified no SDVOSB or VOSB contractors due to their being only one responsible source. Proprietary parts, tools, materials, and software as applicable. - OEM Certified field service engineer. All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Third party vendors do not have access to OEM parts. Vendor must exhibit and be authorized the ability to complete all operational modifications according and under manufacturer specifications. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
