- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation to be issued. This notice of intent is not a request for competitive quotations. This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE PURCHASE ORDER using the simplified acquisition procedures of FAR Part 13 to: Executive Information Systems, LLC (EIS), Bethesda, MD for the procurement of software maintenance for SAS licenses currently installed at the Federal Railroad Administration. The software currently in use is proprietary to SAS, therefore, only SAS exclusive reseller can provide the requisite software maintenance as no other vendor has the data rights to access the software source code to develop and push software updates and patches or provide technical support on its products. Since the software is proprietary, a restriction is placed on access to the software code that is required to develop updates and patches to the software. Without this access, it is impossible to modify the software code as necesary for these patches and updates. SAS provides the maintenance to the Government exculsively through EIS and SAS does not sell its software maintenance through any other resellers. INTENTION: Award the above-stated requirement directly to EIS. The supplies/services required are available from only one or a limited number of responsible sources under the authority of FAR 13.106(b)(1). Interested sources may identify their interest and capability to respond to the requirement or submit proposals. DURATION: Delivery to be made by no later than�22 September 2020. All quotations received within 3 days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed purchase order/contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
