Amendment 0005 to Solicitation 75A50120R00038 COMBINED SYNOPSIS SOLICITATION This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested, and a written solicitation will not be issued. The solicitation number is 75A50120R00038 and is being issued as a request for proposal. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-07 dated 07-02-2020. This acquisition is not a small business set-aside. �The North American Industry Classification System (NAICS) code is 325412 with a size standard of 750 in number of employees. The Division of Strategic National Stockpile (DSNS), of the U.S. Department of Health and Human Services (HHS) Office of the Assistant Secretary for Preparedness and Response (ASPR), intends to purchase and store Active Pharmaceutical Ingredients (API�s).� The Government intends to evaluate offers and award a contract without discussions with Offerors providing the requested services. Performance is anticipated to begin August 1, 2020. The period of performance� is anticipated to total 5 years. The provision at FAR 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. The provision 52.212-2, Evaluation-Commercial Items, applies to this procurement. Addenda to the provision include evaluation factors, subfactors and evaluation criteria.� Offerors shall include a completed copy of FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer.� (Note, if offerors are registered within the System for Award Management (SAM) and certs and reps are up to date, make a statement to that affect in accordance with this clause.� The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition.� The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial items, applies to this acquisition and FAR clauses applicable are 52.219-6, 52.219-28, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-40, 52.222-54, 52.225-13, 52.232-33, and 52.222-51.� Other applicable clauses including Health & Human Services Acquisition Regulation (HHSAR).
