- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute of Health intends to solicit by a request for quotation from Bruker-Biospin for award on or around August 17, 2020. The purpose of this purchase order will be to provide the NIH with a service contract renewal for 4.7T Bruker Biospin scanner. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811219 with a Size Standard of $22.0M This acquisition is NOT set aside for small businesses. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2020-07 dated August 3, 2020. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The National Institutes of Health Research in the Neurophysiology Imaging Facility (NIF) needs a service contract for 4.7T Bruker Biospin vertically oriented scanner, which is used brain scans in animals, housed in the NIF facility). PROJECT REQUIREMENTS: Independently and not as an agent of the Government, the Contractor shall furnish all the necessary services, services, qualified personnel, material, equipment, and facilities, not otherwise provided by the Government as needed to perform the Statement of Work below: 1. The contractor shall provide telephone support for diagnosis of Covered Equipment malfunction(s). This support will be provided during the hours of 9:00am and 5:30pm (local time at our service office) during our standard workweek. 2. The contractor shall provide replacement parts as required on an exchange (refurbished) or new part basis, at the discretion of NIF staff. All replaced parts shall be warranted for 90 days after installation. 3. The contractor shall provide material for engineering changes that are developed by NIF staff and determined to be appropriate for the instrument. 4. The contractor shall provide software updates for Bruker applications software required to operate the Covered Equipment for each system in the table of Covered Equipment as these updates are released. 5. The contractor shall correct any software deficiencies (�bugs�) in all software updates to licensed Bruker applications software used to operate Covered Equipment by the next update release. 6. The contractor shall provide notification of the existence of software defects or other significant problems related to Covered Equipment functionality as they are discovered and provide a reasonable estimate when a correction will be implemented. 7. The contractor shall contact NIF staff when a service call is initiated to gain a more complete understanding of the problem, recommend diagnostic tests, and interpret the results of any diagnostic tests in consultation with NIF staff. 8. The contractor shall overnight ship replacement parts or materials to the NIF facility if any a diagnostic test indicates that a replacement Covered Equipment component or material is required.� 9. The contractor shall contact NIF staff when a replacement part or material is provided to confirm receipt of the part / material, provide installation assistance as needed, and assess the working status of the instrument following the replacement of the failed component. 10. The contractor shall provide shipping information and pre-paid labels included with the repair items for return of replaced components. Receipt of the defective part / material will designate the dispatch as closed / resolved. 11. The contractor shall continue to consult with NIF staff in all instances which the replacement component or material did not resolve the problem and determine reasonable alternatives to resolve the service call.� If deemed necessary by NIF staff and contractor, an on-site visit by qualified technical representative shall be arranged. Period of Performance: The period of performance is as follows: Base year: 08/15/2020 � 08/14/2021 Option Year 1: 08/15/2021 � 08/14/2022 Option Year 2: 08/15/2022 � 08/14/2023 CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, Bruker Biospin is the only vendor in the marketplace that can provide the services required by NIH. In accordance with FAR part 10, extensive market research was conducted to reach this determination. The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is Bruker equipment, and the new item/service must coordinate, connect, or interface with the existing system by replacing defective components exactly when required. Since Bruker-Biospin is the manufacturer of the scanner and does not permit third party service or parts, only the original manufacturer can meet this requirement. However, interested parties may identify their interest and capability to respond to this notice. The purpose of this requirement is to obtain preventive maintenance services on existing Government-owned laboratory equipment manufactured by Bruker Biospin. The contractor shall be an Original Equipment Manufacturer (OEM) Authorized Service Provider of the Bruker Biospin, and all services shall be performed by OEM certified factory-trained technicians using genuine OEM parts. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, NIMH-NOI- 20-004351.
