- PERFORMANCE WORK STATEMENT (PWS) MAINTENANCE SERVICE OF PARTS WASHERS SOLVENT TANK AND EXCHANGE SOLVENT AND RAG FOR EUSA WIDE � � 1. GENERAL: This is a non-personnel services contract to provide maintenance service of solvent tank and exchange solvent and supply rag for EUSA wide. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. 1.1 Description of Services/Introduction:� The contractor shall provide all personnel, equipment, supplies, facilities, ��� Transportation, tools, materials, supervision, and other items and non-personal services necessary to perform� Monthly Maintenance service of the solvent tank inspect and replace solvent and clean rags bundle as defined in this Performance Work Statement except for those items specified as government furnished property and services.� The contractor shall perform to the standards in this contract. 1.2. Background: The contract shall provide inspect and replace solvent and solvent tank cleaner and clean rag bundle every months for EUSA Wide. 1.3. Objectives: The contractor shall maintain inoperable Solvent Tank and Solvent in good working condition. 1.4. �Scope of Work: The Contractor shall provide an exchange solvent service for the U.S. Government owned ��150 gallon tanks (Qty 1), 120 gallon tanks(Qty 6), and 48 gallon (Qty 136) solvent tanks. The Contractor shall provide on a monthly basis 40 LBs of clean rags and pick up and dispose of used and soiled rags. The Contractor shall provide all necessary skilled personnel, supervision, tools, materials, transportation and other items and services necessary to perform monthly maintenance service on U.S. Government owned parts washers in the 8th Army units. Period of Performance: Base Year:���������� 1 Dec 2020 � 30 Nov 2021 1st Option Period:� 1 Dec 2021 � 30 Nov 2022 2nd Option Period: 1 Dec 2022 � 30 Nov 2023 3rd Option Period:� 1 Dec 2023 � 30 Nov 2024 4th Option Period:� 1 Dec 2024 � 30 Nov 2025 General Information: 1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with (IAW) this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor�s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The contractor shall provide a written Quality Control Plan (QCP) within ten (10) working days after contract award to the KO and COR. Additionally, changes to the QCP shall be submitted to the KO and COR within five (5) working days when changes are made thereafter. After acceptance of the QCP the contractor shall receive the contracting officer�s acceptance in writing of any proposed change to his QC system. 1.6.2 The contractor shall keep records of inspections and make them available to the Government throughout the ��contract performance period and for the period after contract completion until final settlement of any claims under this contract.� The contractor shall collect data, perform self-evaluation, and document performance against standards associated with each specific requirement. The contractor shall address all tasks in the PWS based on the example below: Objective (contract requirement) PERFORMANCE STANDARD What level of performance is required to meet the Performance Objective or Task? Quality Assurance: The government will evaluate the contractor�s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). 1.6.4. Recognized Holidays: The contractor is not required to provide service on US Government legal holidays and Korean National holidays except in emergency situations. US Government legal holidays are as follows ����1 January (New Year's Day) 3rd Monday, January (Dr. King�s Birthday) 3rd Monday, February (President's Day) Last Monday, May (Memorial Day)��� 4 July (Independence Day) 1st Monday, September (Labor Day) ������2nd Monday, October (Columbus Day) 11 November (Veterans' Day) 4th Thursday, November (Thanksgiving Day) ������25 December (Christmas Day) Korean Holidays are as follows: 1 and 2 January (New Year) Lunar New Year (31 December, 1 and 2 January on the Lunar Calendar) 1 March (Independence Movement Day) 1 May (Labor Day) 5 May (Children's Day) Buddha's Birthday (8 April on the Lunar Calendar) 6 June (Memorial Day) 15 August (Liberation Day) Chu-Suk (14, l5 and 16 August on the Lunar Calendar) 3 October (National Foundation Day) 25 December (Christmas Day) 1.6.5. Hours of Operation:� The contractor is responsible for conducting business, between the hours of 0730 to 1630, Monday thru Friday except Korean holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the workforce are essential. 1.6.6. Place of Performance: All services required under the basic award shall be performed at the U.S. Government-Furnished Facilities listed in the below Paragraph 6.3. 1.6.7. Type of Contract: The Government will award a Firm Fixed Price type contract. 1.6.8 Security Requirements: Due to a nature of working on military installation, the contractor is required to observe and practice Operation Security (OPSEC) and Physical Security while engaged in this contract operation. The contractor shall not photograph the vehicles, equipment, materials, and facilities without an explicit written approval by the COR. 1.6.8.1 Antiterrorism Training (AT Level I Training): All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, and controlled access areas shall complete AT Level I awareness training within 14 calendar days after contract award. The contractor shall submit certificates of completion for each contractor employee and subcontractor employee to the COR and KO within 7 calendar days after completion of training by all employees and subcontractor personnel. New employees shall take this training within 14 days after starting work under the contract. 1.6.8.2 Access and General Protection/Security Policy and Procedures: Contractor and all associated subcontractors� employees shall comply with applicable installation, facility, and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshall Office, Director of Emergency Services, or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA, and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. 1.6.8.3. iWATCH Training: The Contractor and all associated sub-contractors shall brief all employees on the local iWATCH program (training standards provided by the requiring activity Antiterrorism and Operations (ATO). This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 14 calendar days of contract award and within 14 calendar days of new employees commencing performance. The contractor shall submit iWATCH training record to the COR within 5 calendar days after completion of the training. 1.6.8.4 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured. 1.6.8.5 Key Control: The contractor shall receive all keys from the servicing COR, and shall sign for keys on DA Form 5513-R (Key Control Register and Inventory). The contractor shall not duplicate the issued keys without an explicit written approval of COR or KO, and shall report the loss of issued keys to the servicing COR within 24 hours of discovering the loss. The contractor is responsible for the replacement cost of lost keys to include the replacement of locks. The contractor shall inventory all issued keys in accordance with AR190-11 (Physical Security) and return all keys to COR upon termination of the contract. 1.6.9. Contractor Qualification: 1.6.9.1. Prime Contractor�s Prior Experience: The prime contractor shall have minimum one (1) year experience within the last eight (8) years from the solicitation issue in performing the same or similar type of services for Solvent Tank maintenance services. 1.6.9.2. The Contractor shall meet qualification requirements stated in (a) and (b) or (c) below in order to deliver and dispose of fresh solvent, used solvent, clean rags, and used rags by appropriate vehicles. In addition, the Contractor shall meet all safety and regulatory requirements to transport and dispose such material by Korean Environmental Governing Standards (KEGS), Waste Control Law, 26-3. Contractor shall provide current and valid certifications. The prime contractor or sub-contractor shall have both a Certificate of Designated Waste Interim Treatment Permission ( ���������������� ) that are listed on its certificate. ) and the registered vehicles (����������������������������������������������������������� OR The Contractor or sub-contractor shall have both of a Certificate of Designated Waste Interim Treatment Permission (������������������������������������������������������� ) and a Certificate of Designated Waste Collect and Transport Permission (�������������������������������������������������������������� ). 1.6.10. Personnel Qualification:� 1.6.10.1. Contract Manager (CM): The contractor shall provide a CM with a minimum of one (1) year experience within the last eight (8) years as the CM in the same or similar type of services to this requirement. The CM shall manage the work forces in daily operation, coordinate with the Government representatives, and maintain a close liaison with the Government. The CM shall be competent in English, fully understand the requirements of this contract, and address all contract related issues to assigned COR. 1.6.10.2. Mechanic: The contractor shall provide a mechanic who shall have license for 1st Class Driver License (1���������������������������������������� ) in accordance with PWS, Paragraph 6 issued by Republic of Korea (ROK) Government. 1.6.11. Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. 1.6.12. Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order. 1.6.13. Key Personnel: The follow personnel are considered key personnel by the government: 1.6.13.1. Contract Manager (CM) and Mechanic: Before removing, replacing, or diverting the CM and Mechanic, the Contractor shall: Submit notification to the Administrative Contracting Officer (ACO) 14 calendar days. Submit justification (including proposed substitutions with resumes of equal or greater qualifications stated in this PWS, Paragraph 1.6.10.1 and 1.6.10.2 in sufficient detail to permit evaluation of the impact on this contract; and Obtain the Contracting Officer's written approval. Notwithstanding the foregoing, if the Contractor deems immediate removal or suspension of any member of its management team is necessary to fulfill its obligation to maintain satisfactory standards of employee competency, conduct, and integrity under the clause at 48 CFR 970.5203�3, Contractor's Organization, the Contractor may remove or suspend such person at once, although the Contractor shall notify the Contracting Officer prior to or concurrently with such action. The list of key personnel may, with the consent of the contracting parties, be amended from time to time during the course of the contract to add or delete personnel so long as the aforementioned items are addressed. 1.6.14. Contractor Personnel: 1.6.14.1. Contract Manager: The contractor shall provide a contract manager who shall be responsible for the performance of the services. The names of the contract manager and alternate(s) shall be provided to the KO in writing prior to the beginning of the first performance period. The contract manager and alternate(s) must be able to read, write, speak, and understand English. 1.6.14.2 The contract manager shall have full authority to act for the contractor on all contract matters relating to daily operations of this contract. 1.6.14.3. The contract manager shall be available during normal duty hours within two (2) hours to meet on the installation with government personnel (designated by the KO) to discuss problems. After normal duty hours the manager or alternate shall be available within four (4) hours. 1.6.14.4. Contractor Employees: The contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the KO as a potential threat to the health, safety, security, general well- being or operational mission of the installation and its population. 16.14.5. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges, which contain the company name and employee name in English 1.6.15. Conduct of Contractor Personnel: The contractor personnel shall observe and obey all U.S., U.S. Army, and U. S. Army installation laws and regulations while working on U.S. Army installations. The contractor personnel shall not wear any military uniforms (U.S. or ROK), and shall not wear any clothing that has or depicts derogatory messages to other personnel, U.S. Government, and U.S. Army. The contractor personnel shall not engage in any type of altercation or violent activities with U.S and other personnel. Any personnel in violation of this paragraph shall be promptly removed from the installation under the Military Police escort if applicable, and shall not be permitted to access the U.S. Army installations until the matter is resolved and re-entrance is permitted by the Garrison Commander. 2. DEFINITIONS AND ACRONYMS: � DEFINITIONS: CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract. 2.2. GOVERNMENT-FURNISHED EQUIPMENT AND MATERIAL (GFE/GFM): N/A 4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES: The Contractor shall supplies, equipment, and services required to perform this contract that are not listed under Paragraph 3 of this PWS. Equipment and materials used in the performance of this contract shall be that which is recognized as standard in the trade, and in accordance with manufacturer�s specifications and condition of equipment. Replacement items shall be standard products from manufactures regularly engaged in the production of such supplies, parts, or materials. Items without technical specifications shall be of acceptable industrial grade and quality and require COR�s approval prior to replacement or repair. 5.� SPECIFIC TASKS: � The contractor shall fill 150 gallons, 120 gallons, and 48 gallons of parts washer solvent tanks with 100% of pure (not recycled) type I cleaning solvent monthly. The contractor shall dispose of the used solvent in the 150 gallons, 120 gallons and 48 gallons of parts washer solvent tanks. Type of Solvent: The contractor shall provide Flash Point cleaning solvent with a minimum of 60.0C degrees. The contract manager shall meet with the COR to discuss maintenance issues and scheduling of maintenance/service as required. COR will coordinated with contract manager for training by the Garrison Environment Office. The Garrison Environmental Office will train Contractor�s safety and environmental representatives to ensure that the contractor is in compliance with applicable safety standards and environmental requirements. The training records shall be provided to environmental office. 5.5 The contract manager shall be available for resolving any delivery or maintenance problems within 3 working days after notification from COR. �5.6. The contractor shall provide a Material Safety Data Sheet (MSDS) reports written in English based on Korean Environmental Government Standard (KEGS) or US Government National Fire Protection Association (NFPA) � Hazard Identification Regulation and using the manufacture�s manual after award contract. The contractor must have authorized license by Korean government to haul and dispose of waste solvent. 5.7. Contractor shall prepare and provide completed copies DA Form 2404�s (Equipment Inspection and Maintenance Worksheet) verified by the COR by the 10th�calendar day of each month to the COR. 5.8. The contractor shall conform to unit Standing Operating Procedure (SOP) and MSDS for the handling of hazardous materials. Hazardous material and waste shall be turned in to the Petroleum, Oil and Lubricant (POL) unit waste collection point only. 5.9. Environmental Management System (EMS) 5.9.1. The Contractor shall perform work consistent with the relevant policy and objectives identified in the Installation�s Environmental Management System (EMS). A copy of the EMS can be found in�or A copy of the EMS is provided in attachment�The Contractor shall perform work in a manner that conforms to Environmental Management Programs and Operational Controls identified by the Installation�s EMS, including pollution prevention, waste reduction, energy use, and natural resource protection outlined in the USAG Daegu EMS manual Document 10.1.1, Environmental Policy. 5.9.2. In the event of noncompliance with Korean local environmental law, regulation or requirement, the Contractor shall immediately respond by taking all appropriate corrective action(s) and notifying the COR and the EMS Manager. 5.9.3. Upon contract award, the COR will notify the EMS Manager to arrange EMS training for Contractor employees if necessary. 5.9.4. Additionally, when ordering supplies for use on Installation, all Contractor personnel shall purchase energy- efficient, recycled or reclaimed material whenever practicable. 5.9.5. Any questions regarding EMS may be directed to the COR. 5.9.6. Safety Plan: The Contractor shall develop and maintain a safety plan that describes all safety requirements for every phase of activities under this contract. A complete analysis for unforeseen safety hazards and unfavorable working conditions shall be made. The contractor shall insure that safety precautions are taken during the performance of this contract to protect the lives of contractor personnel, the property of the U.S. Government, the property of the Republic of Korea, as well as the private individuals and firms who may be exposed to or endangered by the contractor�s actions to maintain minimal accidents/incident, zero loss of life and minimal damage to property. The contractor shall provide a written safety plan with policies, procedures and safety checklist within 15 calendar days after contract award. Any revisions, 5 calendar days after receiving the Government revision. The program shall comply with the Korean Occupational Safety and Health Act (KOSHA). The Contractor agrees to comply with its written program for the life of the contract. Any changes or modification to its safety program will be coordinated and reviewed by the COR, or his/her duly authorized representative. 5.9.6.1. Risk Management Process. The safety plan shall include detailed job related hazards and controls for each work activity. The plan shall include an Activity Hazard Analysis (AHA) for each work activity. The AHA shall include at a minimum the name of the activity/job, the job steps, the job hazards, the tools or equipment required to perform the job, control measures to eliminate or reduce the hazard(s), and a Risk Assessment Code (Risk Assessment Code is an assessment of the probability of the hazard occurring and its potential impact). The contractor shall assure that the safety control measures are implemented. The contractor may use the sample AHA forms in http://www.usace.army.mil/SafetyandOccupationalHealth/ActivityHazardAnalysis.aspx [MSOffice1]�or develop their own. 5.9.6.2. Accident investigations, reports, and logs: The safety plan shall include a copy of the contractor�s accident investigation reporting format, and logs. Report all accidents as soon as possible but not more than 4 hours of accident occurrence to the Contracting Officer/Representative (KO/COR). The contractor shall thoroughly investigate the accident and submit the findings of the investigation along with appropriate corrective actions to the KO/COR in the accident investigation reporting format as soon as possible but no later than five (5) calendar days following the accident. Implement corrective actions as soon as reasonably possible. Re-submit the corrected report within 3 working days. The accident investigation reporting format shall include at a minimum: Contract number and contract name/description. Name of contractor Date/time of accident Date report was completed Detail description of events that lead to the accident Root cause of accident Contributing factors Corrective action(s) to prevent recurrence 5.9.6.3. The following require immediate accident notification and written accident report: A fatality; A permanent total or permanent partial disability; The hospitalization of three or more people resulting from a single occurrence; Property damage of $200 or more. Accidents/injuries resulting in one or more loss workday(s). 5.9.6.4. The Contractor shall provide on a monthly basis 40 LBs of clean rags, pick up and dispose of used and soiled rags. 5.10. Final Inspection: The Contractor shall be responsible for completing a DA Form 2404, Equipment Inspection and Maintenance Worksheet in accordance with DA PAM 750-8 when performing monthly maintenance/service. Any discrepancies noted shall be corrected prior to the final inspection. 6. SPECIAL REQUIREMENTS: In order to transport and dispose of solvent the Contractor shall be submitted license issued by Korean government in hazardous waste and transporting vehicle shall be an appropriate vehicle. This is necessary to protect the U.S. Government in case the material is disposed of improperly. Period of performance records are subject to review by the Contracting Officer and COR upon request. 6.1 `The Contractor shall meet qualification requirements stated in either (a) or (b) below in order to deliver and dispose of fresh solvent, used solvent, clean rags, and used rags by appropriate vehicles. In addition, the Contractor shall meet all safety and regulatory requirements to transport and dispose such material by Korean Environmental Governing Standards (KEGS), Waste Control Law, 26-3. Contractor shall provide current and valid certifications. (a) The Contractor or sub-contract shall have both a License of Designated Waster Interim Treatment Permission (????? ???? ???) and the registered vehicles(????? ?? ? ?? ? ??) that are listed on its License OR (b) The Contractor or sub-contractor shall have both of a licensee Designated Waste Interim Treatment Permission(????? ???? ???) and a License of Designated Waste Collect and Transport Permission(????? ?? ? ?? ? ???) 6.2. Transportation: The Contractor shall be responsible for delivery and pick-up of cleaning solvent and clean rags covered in this contract. The Contractor vehicles shall be appropriate for delivery of supplies and waste shall meet all safety and regulatory requirements by Korean Environmental Government Standards, Waste Control Law, 26-3. 6.3. Estimated Workload Data: The estimated workload data are shown below table.
