- This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) subpart 5.2 - Synopses of Proposed Contract Actions. The U.S. Army Corps of Engineers (USACE), Seattle District intends to award a firm-fixed price contract to Marine Vacuum Service, Inc.� for services to clean the oil water separator as well as handle and dispose of hazardous waste per local, state and national regulations.� The oil water separator is�located at Hiram M. Chittenden Locks, Lake Washington Ship Canal (LWSC), Seattle, WA. The statutory authority for this non-competitive acquisition is FAR subpart 13.106-1(b) (1)� The acquisition does not exceed the simplified acquisition threshold Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available as reasons stated below: 1. The oil water separator is mission essential and therefore there is urgency to get this service done.� Marine Vacuum already has the RCRA 11 testing samples needed to start the service and has already assessed the site. Hazmat concerns limit us in order to be compliant with EPA and ER 200-2-3 USACE Environmental Regulations. The identified contractor has conducted this service previously at the project and is familiar with the facility and equipment involved. 2.� Oral solicitation is more efficient than soliciting through available electronic commerce alternatives. Interested concerns must show ability to provide oil water separator cleaning services. �If no affirmative written responses are received by 10:00 AM Pacific Standard Time on July 29, 2020, an award will be made without further notice. Electronic responses and questions shall be submitted via email to the contracting points of contact listed below. �A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. No solicitation is available at this time. �All information shall be furnished at no cost or obligation to the Government.
