- NOTICE OF INTENT TO AWARD A SOLE-SOURCE PURCHASE ORDER Army Contracting Command � Aberdeen Proving Ground (ACC-APG), Tobyhanna Division, Tobyhanna, PA 18466 intends to award a sole source purchase order to Gamma Scientific, 9925 Carrol Canyon Rd. San Diego, CA 92131 Description of Service: This requirement is for a five (5) Year Service Contract for Calibration of Gamma Scientific Photo Diodes at Tobyhanna Army Depot. Gamma Scientific holds the proprietary rights to Photo Diodes design, hardware and embedded software codes. The Government does not possess the necessary intellectual property rights in software and technical data to perform the maintenance. No other manufacturers who fabricate like products have the access to Proprietary Information/Classified Performance Parameters of the Diodes. Government intends to acquire this service under the guidelines of FAR Part 13, Simplified Acquisitions Procedures and FAR Part 12, Commercial Items. The Government intends to solicit and negotiate directly with Gamma Scientific under the authority of FAR 13.106-1(b)(1). This is not a solicitation for competitive quotes. However, if any interested party that can provide this service, without compromising manufacturing delivery, warranty or mark ups, you may submit a statement of capabilities that may be considered by Tobyhanna Army Depot. A determination by the Government not to compete this proposed requirement is based upon responses to this notice and it is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. The capability statement, a price list and any other information furnished must be via email only and must contain material in sufficient detail to allow the Government to determine if the party can meet the requirements. Capability statements and related materials must be e-mailed to Janeen Damiano at Janeen.l.damiano.civ@mail.mil by 10:30 AM EST on June 20, 2020.
