- LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM Upon the basis of the following justification, prepared in accordance with Federal Acquisition Regulation (FAR) 8.405-6(c), I, as Contracting Officer hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(i)(B) �Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized�. �This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 251, et seq. and 40 U.S.C. 501). Identification of the agency and the contracting activity. U.S. Department of Energy, Office of Fossil Energy, plans to award an extension of the Miracorp Order GS-10F-233AA/DE-DT0008358. Headquarters Procurement Services (MA-64) will execute the action. This document sets forth the justification and approval for the use of Limited-Sources Justification for the Federal Supply Schedule Program. Nature and/or description of the action being approved. Due to the COVID-19 emergency and resulting �Stay at Home Orders� (SHO) issued by various states, the entirety of the positions performing this Order are working remotely away from DOE facilities. A transition to a new contractor cannot be completed until the SHO are lifted and DOE lifts site occupancy restrictions to DOE facilities and resumes day-to-day operations. The place of performance of these services are in Washington D.C. and Germantown Maryland, with contractor employees living in both states including Virginia and Pennsylvania. The President has issued guidelines for Social Distancing that should be followed until April 30, 2020.� Maryland has an indefinite SHO, D.C. SHO ends April 24th and Virginia ends June 10th. A three month extension is required to allow time for resolution of the travel and strict social distancing restrictions to allow for an effective reconstitution of day-to-day operations and allow for a transition to a new contractor. Miracop is currently the only source capable of providing the services required at the level of quality required due to COVID-19. A three month option is also being approved as a contingency against the extensions of the social distancing requirements and a delay to the reconstitution of day-to-day onsite services. The current Order expires May 24, 2020 and the value of the extension is $572,313 for the first three months and $572,313 for an additional option period, for an ultimate value of the extension of $1,144,626. A complete description of the supplies and/or services required to meet the agency�s needs. This is a Management and Administrative Contract that provides a broad range of logistical, administrative, and management support services to the various program offices within the Office of Fossil Energy (FE) in its administration of various responsibilities, projects, and programs. This Order supports the Assistant Secretary of Fossil Energy (ASFE) with preparation and maintenance of: Correspondence logs, data management controls, project administration of intra-ASFE standardized administrative/clerical systems, and procedures. Also the Order provides administrative and logistical support in the conduct of meetings, conferences, seminars, public meetings, and presentations, including graphics and slides, etc. This Order supports human capital efforts by performing job analysis, federal job classifications, develop competencies, specialized experience statements, and questionnaires; draft position descriptions; and develop crediting plans identifying mission critical components of the position. The contractor provides writing support (e.g., techlines, blogs, press releases, success stories, Facebook, Twitter) as well as support efforts to improve FE�s web presence and engagement strategy which also includes graphics development. This Order assists in the implementation of improved processes for managing and tracking controlled correspondence for the various offices and training the controlled correspondence officer. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor�s unique qualifications to provide the required supply or service. FAR 8.405-6 (a)(1)(i) (B) � Only one source is capable of responding due to the unique or specialized nature of the work. Miracorp is the only contractor that can perform these services as it will be impossible to conduct contractor transition activities due to the social distancing requirements resulting from the COVID-19 emergency. The current Order expires May, 24, 2020 and there are no further options. A RFQ, for the replacement Order was issued on December 5, 2019 and [REDACTED: SOURCE SELECTION INFORMATION]. Due to the COVID-19 emergency declaration and resulting SHOs the entirety of the positions performed by this Order are working remotely away from DOE facilities at contractor employee residences to maximize social distancing. [REDACTED: SOURCE SELECTION INFORMATION]. Once social distancing standards are relaxed and DOE lifts the non-essential personnel mandatory telework policy, transition activities can commence. Once these restrictions are relaxed, FE will need the expertise and corporate knowledge of Miracorp to facilitate the reconstitution of the day-to-day onsite services of FE�s front office and program offices. Miracorp personnel are uniquely qualified as they have the personnel who have the corporate knowledge and understanding of the operating environment of FE�s front offices that supports departmental leadership and various program offices providing mission critical activities for the Department. Under the current social distancing requirement, offsite transition activities are impossible. In person interaction is needed for the incumbent contract and the nature of services is highly tailored to the FE management preferences and style; in addition, providing training on several DOE-specific management systems requires in-person demonstration. Miracorp is the only contractor that can perform these services as it will be impossible to conduct transition activities due to the social distancing requirements resulting from the COVID-19 emergency. These services are critical to the continuation of mission critical service for FE. These services are the backbone of FE operations. These services ensure effective planning and communication to allow for program management to operate effectively. Also, FE is under a max-telework environment and loss of these services will be detrimental to the ability of the staff to conduct their work remotely and maintain operational effectiveness. The loss of these services will significantly harm the ability of FE senior leadership in providing effective management of the organization and also impair its ability to coordinate and communicate with Congress, White House and the public during the COVID-19 Emergency; in addition to their response to the resulting economic disruption. The extension of this Order is needed to ensure the health and safety of federal contractors and subcontractors in light of COVID-19 while maintaining continued contract performance in support of agency missions.� �A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d) and FAR 8.405-2(d). The order will be off the current Miracorp GSA Contract and the same discounts will carry over. GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted.� A statement must be made that the supplies and services are available from the FSS. A RFQ, for the replacement Order was issued on December 5, 2019. [REDACTED: SOURCE SELECTION INFORMATION]. A thorough market research to extend the current Order was not done due to the rapid development of the COVID-19 Emergency that resulted in swift social distancing requirements which prohibits any contractor from being able to perform a transition activity.
