- THIS IS A PRE-SOLICITATION NOTICE AS REQUIRED BY FAR 5.203(a) AND FAR 36.313-2. THE ACTUAL SOLICITATION WILL BE POSTED JUNE 9, 2020. PROJECT TITLE: CROW CREEK AGENCY CHIP AND SEAL PROJECT BACKGROUND: The Bureau of Indian Affairs has a requirement to reconstruct an existing road, Route #2, with Chip Seal, approximately 6.79 miles. The Tribe does not have the option to contract this project under P.L. 93-638, Subpart J, therefore the Bureau of Indian Affairs is soliciting this work to be done on behalf of the Tribe. The Tribes does have a TERO Ordinance that will apply. The current TERO Tax is 8% and is due prior to the Notice to Proceed being issued. A copy of the Ordinance will be made a part of the solicitation. DESCRIPTION: Contractor to provide all labor, materials and incidental costs associated with the re-construction of an existing road. All work shall be completed under the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects - FP-14, Plans/Specifications, contract terms and conditions and the Construction Wage Rate Requirements. PROJECT LOCATION: Crow Creek Reservation, Ft. Thompson, South Dakota, Buffalo County. MAGNITUDE OF PROJECT: As required under FAR Part 36.204, Project Magnitude is between $150,000 - $250,000 SOCIOECONOMIC PROGRAMS: This procurement is being set-aside exclusively for Indian Small Business Economic Enterprises(ISBEE) as defined under the Buy Indian Regulations 48 CFR PART 1480. Only those vendors that are registered in SAM as a small Native owned business under the stated NAICS Code can submit a bid. Due to issues with SAM, all bidders will need to be registered and active at the time bids are due. Those not registered will be eliminated and determined as non-responsive. For informational purposes, the North American Industry Classification Code (NAICS) is 237310 - Highway, Street, and Bridge Construction with a size standard of $36.5mil. SITE VISIT: A formal site visit will not be scheduled. Additional information on how to visit the site will be made a part of the solicitation. BONDING: FAR Clause 52.228-15, Performance and Payment Bonds-Construction, will apply, along with FAR Clause 52.228-1 Bid Guarantee. CONSTRUCTION WAGE RATES: Contractor will also comply with the Construction Wage Rates for Buffalo County, South Dakota. A copy of the rates will be attached to the solicitation. PERMITS: Applicable Permits, archeological and environmental clearances have been acquired. DATES: The Solicitation will be posted June 9, 2020. Bid Opening is set for July 9, 2020 at 2:00 pm CT. The Government anticipates the award to be made by July 30, 2020. Notice to Proceed will be issued once bonding and insurance is provided, with 90 days to complete all work after Notice to Proceed (NTP) is issued.
