- Sole Source Notice Description: NOTICE OF INTENT TO SOLE SOURCE The Office of Acquisitions and Grants Services (OAGS) intends to sole source using the authority of FAR 6.302-1(b)(1)(i), unique supplies or services available from only one source or only one supplier with unique capabilities. Only the prospective contractor, GrayShift, LLC. (located at 1011 Mansell Rd Ste B, Roswell, GA, 30076), can provide maintenance support to the three (3) existing GrayKey licenses, which were purchased by Food and Drug Administration under 75F40119P10208, without violating the manufacturing license warranty. The requirement is to acquire three (3) 12-month maintenance support to three (3) existing GrayKey licenses to allow investigators from FDA-Office of Criminal Investigations (OCI) to access data found on iOS devices for use in investigations. FDA-OCI protects the public health and furthers the FDA mission by investigating alleged criminal violations of the Federal Food, Drug, and Cosmetic Act (FDCA) and other related statutes. FDA-OCI concentrates its resources on investigations that pose a significant danger to public health. The Seized Computer Evidence Recovery Specialists (SCERS) who work for FDA/OCI are responsible for imaging and processing computers, cell phones, tablets, and other electronic media that is encountered and/or recovered during the course of investigations for use in court. In order to analyze many image sets, forensic software and hardware that is capable of parsing out many types of mobile device operating systems are necessary for conducting examinations. One such operating system is iOS. The GrayKey is a hardware unit that allows for access to the iOS devices while maintaining the chain of custody in order to extract and analyze evidentiary data once lawful access is established. The North American Industry Classification System (NAICS) code for this requirement is 541519 with the size standard of $30 million. This notice of intent is not a request for quotes; however, all responsible sources may submit a quote within 15 days of issuance of this notice of intent. All responses must be submitted to the Government point of contact at the email address shown below. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government.
