All changes made by the following Government responses on the succeeding pages hereby amends the terms of the solicitation. Robert Wilson Contracting Officer - Div 5 VA-OPA-2019-2ED5F4D QUESTIONS AND ANSWERS Q1. CLINS 0003 0005; will they be technically evaluated to the only salient characteristics? The evacuation sled must offer a wall storage system . Will the salient characteristics be added to the evaluation factors? GOVERNMENT RESPONSE: No additional salient characteristics (SC) will be added. Currently, there are no Salient Characteristics (SC) that specifically apply to CLINS 0003, 0004, and 0005. SC 5 The evacuation sled must offer a wall storage system applies to CLINS 0001 and 0002 only. As stated in solicitation Attachment B Product Description, vendors offering an equal brand product must indicate that each product being offered is as an equal product to the Med Sled� Emergency Patient Evacuation Sleds and will satisfy the salient physical, functional, or performance characteristics in the item description as follows: CONTRACT LINE ITEMS BRAND PART NUMBER DESCRIPTION 0003 Med Sled MSSD4 Sled Storage Device - Accommodates (4) MS36 stacked vertically 2 on top of 2 Or 2MS36 and 1 MS48 0004 Med Sled MSSD10 Sled Storage Device - Accommodates (10) MS36 stacked horizontally 0005 Med Sled MSSDB6 Sled Storage Device - Accommodates (6) MS36 or MS48 positioned side-by-side, any combination Q2. Could the VA provide the literature that will be reviewed for method of evaluations? This is to mitigate any ambiguity or possible interpretation differences to compare products to the applicable item being provided per clin. GOVERNMENT RESPONSE: The Technical Evaluation approach is provided in solicitation Attachment E Solicitation Provisions, specifically Section E.4 ADDENDUM to FAR 52.212-2 EVALUATION COMMERCIAL ITEMS (OCT 2014) (c) which states : Only OEM parts as listed on the ATTACHMENT B EMERGENCY PATIENT EVACUATION SLED - PRODUCT DESCRIPTION LIST or equal are acceptable and will be evaluated in accordance with FAR 52.211-6 Brand Name or Equal. Only new equipment is acceptable; no remanufactured or ""gray market"" items. Quotes that merely restate the requirement or state that the requirement shall be met, without providing supporting rationale, will not be sufficient. To receive a rating of Acceptable. The quote must demonstrate the vendor s ability to meet the salient characteristics listed on ATTACHMENT B EMERGENCY PATIENT EVACUATION SLED - PRODUCT DESCRIPTION. Distributors must be authorized distributors and certified by the OEM. The Government will ONLY evaluate the quote s literature submission in Volume I Technical to determine a rating for Factor 1 Technical. In accordance with Section E.3 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO QUOTERS COMMERCIAL ITEMS, quoters shall provide descriptive literature which will be used to determine if the quoted products are technically acceptable. Additionally, the use of hyperlinks in the quote s Volume I Technical to access online content or files is prohibited. Failure of the quote to meet all the technical requirements listed in the solicitation may cause the quote to be rated Technically Unacceptable. Q3.� Can you provide written documentation on what Stairwell Braking System is? Pictures or a Video? We looked at the Brand Name Med Sled video on YouTube and did not see a stairwell breaking system instead we saw a medsled with a rope connected to the stairwell and being held by someone WHO IS THE BREAKING SYSTEM .if the person lets go of the rope .the Medsled does not stop how is this a breaking system when it does not stop? Will you please remove this characteristic as this is not a true braking system by the mechanics of how it works, this is more a marketing language. (see YouTube video med sled training: schools ) also during an emergency evacuation, tethering to the stairwell will only slow the evacuation process as you have to keep hooking and unhooking all the way down the stairs with ropes the length of the stairwell dangling everywhere when in an emergency am sure the stairwell will be filled with individuals evacuating while trying to avoid the tethering ropes. GOVERNMENT RESPONSE: The functional purpose of a stairwell braking system is to allow staff members to execute a safe and controlled patient decent on the Emergency Patient Evacuation Sled. This requirement is for commercial off the shelf equipment and no parts will be modified in order to meet the salient needs of the Government. VA does not own technical specification data for the Med Sled� model of a stairwell braking system. This is a FAR 52.211-6 Brand Name or Equal requirement for commercial items. As stated in the solicitation Attachment B - Product Description, SC 7 - The evacuation sled shall include an internal (mounted into the unit) or external (separate from the unit) stairwell braking system. The Med Sled� models MS36 and MS48 come standard with a stairwell braking system. Equal brands must also offer either an internal or external stairwell braking system either included in CLINs 001 and 002 or as a sperate contract line item (CLIN). Q4. Is the facility hand railing that these med sleds are going to be tethered to cleared by your facility safety and engineering department for tethering patient transport devices to facility handrails? This is a possibility liability concern for the VA should the handrails give way, the product manufacturer will not be liable as its your handrail installation not the product manufacturer. Break is to stop, the training video shows one evacuator on the top landing and one on the bottom, the one on the top is holding on to keep the tether tight so the sled would not run away or have jerking motion during descend . because if they let the AKA breaking rope go it shows it does not break and you have a runaway sled. Attaching the carabiner to anchor points on the hand railing is not safe by any means as the handrails were not designed or installed to manage the load bearing transport devices, all the more reason to remove this salient characteristic. GOVERNMENT RESPONSE: Each VA Medical Center who orders off the resulting NX EQ contract will be responsible for the installation and safe handling of the product s stairwell braking system. Currently, several hospitals have used the Med Sled� model and there are no reports of malfunction or injury. Q5. D.14 VAAR 852.219-74(a) This solicitation includes 52.219-4 Notice of Price Evaluation Preference for Total Service-Disabled Veteran Owned Small Business Set-Aside. FAR Clause 52.219-4 is Notice of Price Evaluation Preference for HUBZone Small Business Concerns. This is an error. IAW FAR Subpart 19.1309(b) (1) The contracting officer shall insert the clause at 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns, in solicitations and contracts for acquisitions conducted using full and open competition. The Set-aside is for SDVOSB; Not HUBzone. Will this clause be removed that it is erroneous and not applicable to this solicitation? GOVERNMENT RESPONSE: The clause will not be removed and there is no error to the solicitation provisions. Solicitation Attachment D Emergency Patient Evacuation Sled Contract Clauses, specifically D.3 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS COMMERCIAL ITEMS (JAN 2020), (12)(i) 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns (Mar 2020) (if the offeror elects to waive the preference, it shall so indicate in its offer) (15 U.S.C. 657a) is not checked and does not apply to this solicitation or the resulting award. Q6. Review of Attachment E in Provision - E.10 52.233-2 SERVICE OF PROTEST (SEP 2006); it annotates that any protest shall be mailed or hand-carried.� Will this clause be updated to annotate VAAR 852.233-71 ALTERNATE PROTEST PROCEDURE Email address EDProtests@va.gov. GOVERNMENT RESPONSE: Solicitation Attachment E Solicitation Provisions, specifically E.10 52.233-2 Service of Protest (SEP 2006) provides the correct and efficient instructions for filling an Agency Protest with instructions to submit a copy to Government Accountability Office (GAO). VAAR 852.233-71 Alternate Protest Procedure supplements those instructions by providing an e-mail address where the Agency Protest can be submitted. Q7. Due to the Coronavirus this exposes vendors to additional risk and is a safety concern. Will FAR Provision 52.233-2 be updated for no ambiguity/conflicting information? GOVERNMENT RESPONSE: Solicitation Attachment E Solicitation Provisions E.10 52.233-2 SERVICE OF PROTEST (SEP 2006) provides a Mailing Address where the protest can be safely submitted to our office and copied to GAO. VA will be able to receive the correspondence while complying with the guidelines mandated by the CDC. VAAR 852.233-71 ALTERNATE PROTEST PROCEDURE is already included in the solicitation.
