- Notice of Intent for the Government to Issue a Sole Source Award Contract to Transformational Security, LLC (TS). NOTICE OF INTENT TO SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract, and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 13.501(a). The Department of Defense (DoD), Washington Headquarters Services, Acquisition Directorate, (WHS/AD) intends to issue a sole source, firm fixed price contract to Transformational Security, LLC., at 9105 Guilford Road, Columbia, MD 21046, to procure a In-Place Monitoring System (IPMS). This requirement is in support of the Pentagon Force Protection Agency (PFPA) mission to continually provide technical security support to the Office of the Secretary of Defense (OSD) for the protection of classified information used in daily operations at the Pentagon. The creation of the IPMS system in 1999 was directed by the Deputy Secretary of Defense to counter the current and future hostile collection attempts directed against the Pentagon and the Department of Defense. This employment of electronic countermeasures was designed to ensure sensitive or classified national defense information would not fall into an adversary�s possession. The design of this IPMS is unique to the Department of Defense and constitutes the largest IPMS within the Federal Government. A follow-on contract with the past Contractor is required to ensure the proper operation of the IPMS current use at the Pentagon. The IPMS works under proprietary APEX software designed by Agilent Technologies. The intellectual property and licensing rights are now solely owned by Transformational Security, LLC (TS), a Service Disabled, Veteran-owned Small Business. TS has exclusive rights to the license to use, change, enhance, maintain, support, market, reproduce, and sell the APEX product and all of its artifacts and components including, but not limited to, its name, software source code, design, documentation, training, and support material. This procurement is being conducted in accordance with Federal Acquisition Regulation (FAR) 13.5 under the authority of 41 U.S.C 1901, Simplified Acquisition Procedures. The NAICS code utilized for this procurement is 541990 � �All Other Professional, Scientific, and Technical Services.� The associated products service code (PSC) is R425, �Engineering and Technical Services.� This notice of intent is NOT a request for proposal or quotation. Request for copies of a solicitation in response to this notice will not be honored or acknowledged. However, any responsible sources may submit a capability statement demonstrating the ability to provide the requested products, which shall be considered as market research purposes for future purchases of the required products.
