Description
The Naval Air Systems Command (NAVAIR) intends to issue a modification to Delivery Order 0073 under Basic Ordering Agreement N00019-12-G-0006 with the Bell Boeing Joint Program Office on a sole-source basis.� This modification will cover additional non-recurring engineering (NRE) and baseline performance rig test efforts in support of the preliminary design of the Improved Inlet Solution (IIS) / Engine Air Particle Separator (EAPS) for the MV-22 and CV-22 Tiltrotor aircraft.� The testing will comprise of a static inlet test to characterize baseline inlet particle separator aerodynamic performance and separation efficiency.� This requirement will be procured in accordance with the statutory authority permitting other than full and open competition under Title 10 U.S.C 2304(c)(1), as implemented by FAR 6.302-1, ""Only one responsible source and no other supplies or services will satisfy agency requirements."" As the sole designer, developer, and manufacturer of the V-22 tiltrotor aircraft Bell-Boeing is the only known source that possesses the engineering data, and is the only source that has unrestricted access to the totality of technical data needed to support the requirement herein. Further, the Government does not possess adequate license rights to the required technical data package necessary to support a competitive procurement to fulfill the requirement herein.
