- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition Contracting Activity: Department of Veterans Affairs, VISN 10, Chalmers P. Wylie Veterans Affairs Ambulatory Care Center (VA ACC), 420 North James Rd, Columbus, Ohio 43219. This is to request Sole Source Procurement under the Justification for Other than Full and Open Competition for endoscopy repair services. Purchase request: PR # 757-20-2-291-0075 Cost: $75,944.00 Nature and/or Description of the Action Being Processed: The acquisition is to be purchased under a simple acquisition plan and the services include the labor, travel and all other incurred cost of endoscopy repair services. Performance will be monitored, reported, and payment rendered. This service plan will be awarded as a new firm-fixed-price simplified purchase order. Description of Supplies/Services Required to Meet the Agency s Needs: This acquisition is to request the Original Equipment Manufacturer (OEM) perform endoscopy repair services. Statutory Authority Permitting Other than Full and Open Competition: 41 USC �253(g), as implemented by FAR 6.302. ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): These scope repairs are proprietary to Karl Storz. Karl Storz does not train, certify or authorize 3rd parties to repair their scopes. Any 3rd party repairs void s the Karl Storz Warranty. OEM repair these devices as to not void warranty or product performance and safety. Please see attached Proprietary letter from vendor. Any third-party repair could cause the government to incur unnecessary costs or liabilities. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement was not competed/synopsized due to proprietary nature of the technology. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Contracting Officer has determined that the anticipated cost to be considered fair and reasonable. Pricing information has been determined to be current and provides maximum allowable benefits to the government. This is based off experience concerning specific dealers prices. (FAR 13.103, 13.106-1(a)(1)). Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The market research that was conducted included speaking with multiple providers and talking to Subject Matter Experts. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A follow on contract is expected to provide services on an IDIQ contract. This is expected to begin in Q1 FY 20. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
