Description
A provision of the Competition in Contracting Act (CICA) of 1984, authorizes noncompetitive contracts to be performed by only one or a limited number of sources via 10 U.S.C. � 2304(c)(1); Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii) (A) and (B). As such, for the purposes described hereunder and in accordance with the FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, coupled with the Authority 10 U.S.C. 2304(c)(1), the United States Army Corps of Engineers, Detroit District, intends to execute, without competition, a bilateral Contract Modification under Contract W911XK19C0020. The incumbent Contractor is Roen Salvage Company; the address for this organization is 180 East Redwood Street, Sturgeon Bay, Wisconsin 54253-2732, with a DUNS of 002771673.� �� The resulting modification will implement four (4) new contract line items (CLINs), consisting of the following: �additional 288 linear feet of repairs to the Superior Entry North Pier, fill stone, and scour stone comparable to the repairs being installed under the current contract and concrete fill for channel side of pier (instead of grout) for the new work. �Repair work consists of removing the 4 feet by 5 feet knee wall of the existing concrete pier. The existing north pier structure will be encased in a steel sheet pile wall with stone fill and concrete. Scour stone will be placed at the base of the steel sheet pile. Stone removal and replacement will be required at the steel sheet piling (SSP) drive line. Demobilization from the site when work is completed The incumbent Contractor, Roen Salvage Company would be required to complete additional 288 linear feet (remaining length to the end of the north pier) of repairs, which is in close proximity to the current construction contract. Roen Salvage Company is in the best position to carry out this work, which will immediately address: (1) Real Estate/Access Concerns The Superior Entry North Pier Repair project includes the installation of SSP repairs and presents the opportunity to utilize real estate already obtained for the project for access and laydown area to perform the modification work.� The Government provided real estate under the current contract is the only real estate the Government was able to obtain for this project, which has limited space and is not conducive for more than one (1) Contractor working in the vicinity. The incumbent Contractor was able to obtain their own real estate which is closer to the project allowing for concrete fill to be performed cost efficiently and within the established contract schedule.� Additional Government provided real estate is not available or could be obtained for the additional 288 linear feet repairs beyond that obtained for the current contract. (2) Avoid Multiple Contractors in the same Vicinity The work will be completed at the north pier which is in close proximity to the current construction contract. Since work is ongoing by the incumbent Contractor, the installation of additional SSP repairs by this same Contractor will avoid multiple contractors working in the same work areas, which may significantly increase safety risks. The contract type will remain a firm fixed construction contract. The applicable North American Industry Classification System (NAICS) code is 237990, Other Heavy and Civil Engineering Construction.� This Notice of Intent is not a request for competitive proposals or solicitation is not intended to be issued.� However, all responsible sources may submit a capability statement which shall be considered by the agency. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are not acceptable in response to this notice.� A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government. Responses and questions shall be submitted to Stacy Wiggins at stacy.s.wiggins@usace.army.mil by 2 April 2020 at 10:00 a.m. Central Time.� The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice. The primary purpose of this notice is to publicize this contract action prior to contract modification, as mandated in FAR Subpart 5.2, Synopses of Proposed Contract Actions and FAR Subpart 6.3, Other Than Full and Open Competition.
