Description
Special Notice Spectralis Optical Coherence Tomography (OCT) System The Program Contract Activity Center in Independence, OH intends to negotiate a sole source contract with L1 Enterprises, a VIP-verified Service-Disabled Veteran-Owned small business (SDVOSB) and the only authorized distributor of Heidelberg Engineering, the manufacturer of the Spectralis OCT System. The department of Veterans Affairs, VISN 22, VA San Diego Healthcare System (VASDHCS) has a requirement to purchase a Spectralis OCT System in support of the activation of the Chula Vista Community Based Outpatient Clinic which is currently under construction. The Spectralis OCT system consisting of the following items: CLIN MFG Item# Description QTY 0001 0226-OCT2-BP-ADV Spectralis OCT System OCT w/OCT2 Blue Peak-Advanced 1 0002 88024A OCT Angiography 1 0003 0226-ASM Spectralis Anterior Segment Module 1 0004 0238-233 HEYEX Network License 5-pack 1 The North American Industry Classification System Code (NAICS) is 339112 - Surgical and Medical Instrument Manufacturing. The Spectralis is an ophthalmic imaging platform with an upgradable, modular design allowing clinicians to configure the system to the specific diagnostic workflow in the clinic. OCT images require comparative analysis across time and across clinics (VA San Diego Medical Center, Oceanside Community Based Outpatient Clinic (CBOC), Mission Valley CBOC, and the Chula Vista CBOC. The Optometry/Ophthalmology Department at the San Diego VA Medical Center has already purchased and installed HEYEX server infrastructure. The HEYEX server is specific to Heidelberg Engineering instruments and allows clinicians to view all the raw data obtained from any OCT imaging study performed. The HEYEX also provides comparative analysis across all images performed. No other products are compatible with the San Diego VAMC s existing HEYEX server infrastructure. There is no alternate server that will allow multiple manufacturer s devices to share and compare data. To switch to another system would cost the Government in excess of $300,000.00 to purchase new equipment and a new server. This procurement is being conducted under the authority of FAR 6.302-5- Authorized or required by statute, specifically, 38 USC Sec. 8127(b) which states a contracting officer of the Department of Veterans Affairs may use procedures other than competitive procedures to meet contracting goals by entering into a contract with a small business concern owned and controlled by veterans for an amount less than the simplified acquisition threshold. This notice of intent to sole source is not a request for competitive quotes. However, any firm that believes it has the technical capability to fulfil this requirement may submit a technical submission which provides clear and convincing evidence that it can meet the Government's requirement. Firms must either be the original equipment manufacturer (OEM) or authorized by the OEM as a distributor. A nonmanufacturer rule waiver has not been issued by the SBA for the applicable NAICS code and Product Supply Code (6540). Therefore, firms who are not the OEM must meet SBA s nonmanufacturer rule requirements. Non-OEM respondents must include documentation in their response indicating they are an OEM-authorized distributor and will be in compliance with SBA s nonmanufacturer rule. Vendors who are not registered in System For Award Management (SAM) database prior to award will not be considered. Vendors may register with SAM by going on via the web to https://www.sam.gov. Responses must be received within five (5) days of this notice by 9:00 a.m., Eastern Standard Time. Responses should be submitted electronically to Sandra.Mruk@va.gov and Sandra.Johnson3@va.gov This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received by the response date stated above. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. TELEPHONE REQUESTS WILL NOT BE HONORED. This notice does not commit the Government to contract for any supply or service. The Government will not pay for any information or administrative costs incurred in response to this notice.
