- INTENT TO SOLE SOURCE The U.S. National Institutes of Health (NIH) in Bethesda, MD intends to enter into a sole source procurement with Siemens Energy, Inc., 4400 Alafaya Trail, Orlando, FL 32826. NAICS 811310 � Commercial and Industrial Machinery and Equipment (except Automotive and Electronic) Repair and Maintenance.� The proposed contract action is for maintenance and repair of a Siemens SGT-600 gas turbine, which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.� The contract period of performance will be May 1, 2020 � April 30, 2021, with four (4) one-year options periods.� This notice of intent is not a request for proposal.� Interested parties may identify their interest in the requirement and capabilities to Neha Dhir by email at neha.dhir@nih.gov, Daniel Hall at daniel.hall@nih.gov, and Katherine Aitken @ Katherine.aitken@nih.gov no later than March 30th, 2020.� Telephone inquiries will not be accepted.� All information shall be furnished at no cost or obligation to the government. �The SGT-600 shall be maintained in accordance with the Siemens SGT-600 Maintenance Schedule (attached).� For emergency repair services, Siemens shall furnish all labor, material, repair parts, equipment, software updates, and travel necessary to correct any equipment to operational condition.� Siemens shall guarantee that at the conclusion of any emergency maintenance performed, the equipment will meet the Siemens factory specifications. (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for OEM parts and services for the Siemens SGT-600 gas turbine. �No remanufacture or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed parts and services, such that the OEM�s warranty and service are provided and maintained. �All software licensing, warranty and service associated with the proposed parts and services shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the NIH for this requirement constitutes a breach of contract. Accordingly, the NIH reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at NIH�s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to NIH upon discovery of such items. No solicitation will be made available. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the government not to complete this proposed contract based upon responses to the notice is solely within the discretion of the Government.
