Description
DEPARTMENT OF TRANSPORTATION (DOT) SOLE SOURCE SPECIAL NOTICE FOR BETA.SAM.GOV and JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION This is a SOLE-SOURCE Special Notice.� On a SOLE-SOURCE basis, the U. S. Department of Transportation (DOT) plans to award a contract to Rapiscan Systems for the X-ray systems maintenance project described below�because, for the reasons given below, DOT believes that Rapiscan is the ONLY company that is capable of meeting DOT�s needs at the high level of quality indispensable to the Department.�� Nevertheless, any interested�firm OTHER THAN Rapiscan may attempt to prove its capability for performing the project described below by e-mailing a Statement of Qualifications to Hank.Clyatt@dot.gov and to Ellen.Polsky@dot.gov and to James.Mowery@dot.gov and to� Avi.Lopin@dot.gov not later than 11:59 PM Eastern Time March 8th, 2020. 1. Agency and Contracting Activity. � US DOT/OST/M40 OST Office of Security (M-40) 1200 New Jersey Avenue, SE Attn:� Hank Clyatt, Room W54-135 US Department of Transportation OST, Acquisition Services (M-63) 1200 New Jersey Avenue, S.E. Washington, DC 20590-0001 2. Nature/Description of Action(s). ��Rapiscan Systems, Inc., manufacturer of the GEMINI X-ray Inspection Systems, are proprietary due to their patented Rapiscan Systems technologies (Z-backscatter).� Detailed schematics and proprietary system information is only provided to Rapiscan Systems service personnel. Rapiscan Systems x-rays contain high voltage.� Personnel, who are not properly trained in servicing Rapiscan Systems x-rays, may induce further damage to the systems, cause personal injury and even death.� Furthermore, individuals working on Rapiscan Systems x-rays who are not properly trained and certified by Rapiscan Systems, may void system or component warranties. Rapiscan Systems will provide a Service and Maintenance Agreement for one (1) Rapiscan Systems Gemini X-ray systems. The estimated�BASE-Year cost is $9,000.00, which will be funded using the following accounting data:� 14SEC2020.1710.25710.1504001020 In addition, the needed Rapiscan contract will have four�OPTION Years, each of which is estimated to have a cost similar to that of the Base Year. The Service and Maintenance Agreement period is for April 1, 2020 � March 31, 2025 including 4 option years. 3. Description of Supplies/Services. This requirement is to purchase the following: Rapiscan Gemini X-Ray Service and Maintenance Agreement at U.S. Department of Transportation Headquarters, from Rapiscan Systems, Inc. 4. Identification of Statutory Authority.� Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C. 2304(c) (1). 5.� Demonstration of Contractor's Unique Qualifications. Rapiscan Systems, Inc. is the only company that is able to provide an x-ray inspection system utilizing Z-Backscatter technology.� Z-Backscatter is a patented technology based on the X-ray Compton Scattering effect.� Z-Backscatter works by detecting and highlighting ""low Z"" materials (items that contain low atomic number elements such as carbon, hydrogen, oxygen and nitrogen).� Low Z materials include explosives, plastic weapons, drugs, alcohol and tobacco.� These items appear bright and well defined in Z-Backscatter images, making it easy to identify hidden organic and inorganic materials, and to determine which might be security threats.� The high quality and clarity of Z-Backscatter images create photo-like images, allowing for accurate and rapid interpretation unachievable with traditional transmission x-ray images alone.� This x-ray inspection system will help reduce operator fatigue while increasing productivity. Rapiscan Systems holds more than 20 patents on Z- Backscatter technology. 6.� Beta.Sam.gov Contract Opportunities Announcement/Potential Sources.� This sole source Special Notice provides the opportunity for interested�firms OTHER THAN Rapiscan to attempt to prove their capability for performing this project by e-mailing a Statement of Qualifications to Hank.Clyatt@dot.gov and to Ellen.Polsky@dot.gov and to James.Mowery@dot.gov�and to Avi.Lopin@dot.gov not later than 11:59 PM Eastern Time March 8th, 2020.. 7.� Determination of Fair and Reasonable Price. The Contracting Officer and the Contracting Officer�s Representative (COR) have jointly determined that Rapiscan Systems' price�which is expected to be approximately $9,000 for the Base Year and about the same for each of the four Option Years�will be fair and reasonable, based upon the COR�s past experience in purchasing security systems, and based on market research performed by the COR, as described in the following section numbered 8. 8. Description of Market Research. The Office of Security (M-40) would normally obtain other company estimates; however, there is no other company that can provide the needed Z-Backscatter technology, which is patented by Rapiscan Systems and is not available from any other vendor. Rapiscan Systems is the only company that can service their X-ray equipment and software.� M40 has completed a search of Beta.Sam.gov Contract Opportunities for contract awards in the last year that are comparable to this purchase and has found none. 9. Any Other Supporting Facts. Rapiscan Systems X-ray Inspection Systems are proprietary and cannot be serviced by other vendors. 10.� Listing of Interested Sources.� No other interested sources were known to DOT, as of the date of publication of this Sole Source Special Notice in Beta.Sam.gov . 11.� Actions Taken to Remove Barriers to Competition. The Contracting Officer and the COR do not know of any barriers to competition�except, of course, for the unavoidable fact that Rapiscan Systems legally holds proprietary rights to that firm�s X-ray Inspection Systems.� As noted above, this published Sole Source Special Notice does provide fair notice regarding this requirement to any interested firms other than Rapiscan. �Moreover, it would be the intention of the Contracting Officer and the COR to again publish a similar Sole Source Special Notice in conjunction with any FUTURE follow-on procurement for any similar and additional X-ray equipment maintenance-service�which might hereafter be needed by OST�s Office of Security. 12.� Statement of Period of Performance and/or Delivery Schedule.� Base Period running from April 1, 2020 � March 31, 2021, with 4 Option Years. 13.� Reference to the Approved Acquisition Plan (AP)/Program Plan (PP).� This requirement does not require an acquisition plan. TECHNICAL AND REQUIREMENTS CERTIFICATION: DOT�s cognizant COR, Mr. Hank Clyatt, has certified the truth and accuracy of the facts recited above.
