- Synopsis of Contract Award - Foreign Military Sales to Reel Power In accordance with FAR 6.302-4(b)(1), International Agreement 10 U.S.C. 2304(c)(4), Foreign Military Sales (FMS) Case: Korea KS-P-LQP.� 28 January 2019 MEMORANDUM SUBJ:� SOLE SOURCE JUSTIFICATION FOR PROCUREMENT OF THE MD TOTCO LM2000 INSTRUMENTED SHEAVE LINE TENSIOMETER MONITORING SYSTEM TO SUPPORT FMS CASE KS-P-LQP (ERP Number 1300763786) ����������� � 1.�������� Identification of the agency and the contracting activity, and specific identification of the document as a �Limited Source Justification.� This is a sole source memorandum.� Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 024. � 2.�������� Nature and/or description of the action being approved. This action will award a purchase order, on a sole source basis, to Reel Power Industrial Incorporated, 5101 S. Council Road, Suite 100, Oklahoma City, OK 73179, to acquire a Re-Reeving Machine for���������������������� . The re-reeving machine is for reels up to 60� in diameter and up 48� wide with a weight capacity of up to 5,000 pounds. ��This procurement is in direct support of Foreign Military Sales (FMS) Case: Korea KS-P-LQP.�� 3. ������� A description of the supplies or services required to meet the agency�s needs (including the estimated value). The following equipment is being acquired: Item��������������������������������������������������� Model������������������������ ��� Quantity Re-Reeving Machine������������������������� RR5-011-001������������������������� 1 The Government�s minimum needs have been verified by the certifying technical and requirements personnel.� This memo does not authorize acquisition for other requirements. The estimated value of this procurement is $44,836. ��This contract action is funded with 2020 Foreign Military Sales (FMS) Funding. � 4.�������� Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor�s unique qualifications to provide the required supply or service, FAR 6.302-4(b)(1), International Agreement 10 U.S.C. 2304(c)(4). . The Defense Acquisition Program Administration (DAPA of the Republic of Korea (ROK) has procured ������������������������������via FMS Case KS-P-LQP.� The ���������includes a re-reeving machine required for deployment and recovering���������������� .� The re-reeving machine, manufactured by Reel Power Industrial, is the only equipment that can be used with the�������� , is therefore, solely qualified to meet the Government of Korea�s specific request for the following reasons: Reel Power Industrial (RPI) is the Original Equipment Manufacturer (OEM) for the re-reeving machine. RPI owns the intellectual rights for re-reeving machine. �No other contractor will be able to obtain the proprietary rights.� No other contractor will be able duplicate the knowledge and processes necessary to fabricate the machine without a substantial investment in time and money. � The Foreign Military Sales (FMS) customer has requested in writing that the ���comprise the same vendors used in the USN system to ensure that the same systems deployed���� ����������������are provided for the ����������������letter of 5 Feb 2018 to����������� ).� RPI, as the OEM for the re-reeving machine is the vendor for the machine used on�������� .� The FMS customer�s request constitutes an international agreement between the U.S. and a foreign government, an allowable condition for sole-source-procurement limited to FMS case KS-P-LQP. � In summary, RPI�s detailed knowledge of re-reeving machine gives them the unique qualification required to provide the required equipment.� Additionally, the FMS customer, ROK, has requested in writing, he use of the same vendors used in the USN system.� Therefore, it is imperative that only Reel Power Industrial is used to meet this requirement immediately. � � 5.�������� A determination by the ordering activity contracting officer that the order represents the best value. � The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government�s needs. � � 6.�������� A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. � No additional market research was conducted because, as stated in paragraph 4 above, Reel Power Industrial is the only company that can meet this requirement. � � 7.�������� Any other facts supporting the justification. � None � � 8. ������� A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. � As stated in paragraph 4 above, Reel Power Industrial is the only company that can meet this requirement. � TECHNICAL AND REQUIREMENTS REQUESTING OFFICIAL � I certify that the facts and representations under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
