Description
Description: This is a Notice of Intent in accordance with the Competition in Contracting Act, 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, other than full and open competition is authorized when there is only one responsible source and no other supplies and services will satisfy agency requirements to issue an extension of services on a sole source basis in accordance with Federal Acquisition Regulation (FAR) Part 5.201 requiring notice of a proposed contract action. Using exemption to competition 6.302-1(a) (2) (i), One Responsible Source, the Department of Energy (DOE) intends to issue a sole-source labor hour award to extend the current contract award (89303018DLP000002) with Clifford Chance for two additional years (1 base year plus 1 option year) in the amount of $1,000,000.00.�� The award of this contract based on full and open competition is precluded because there is an immediate need for a firm with the specific project expertise and unique qualifications to provide the above described specialized legal services. �Clifford Chance is the current independent legal advisor to the Department for the Project and has been providing independent legal services concerning this Project. Clifford Chance has deep knowledge of the Project and of the urgent circumstances concerning the Project and is a responsive and responsible contractor. �With this knowledge, and available key staffing, Clifford Chance is the only legal advisor that can immediately provide the necessary legal services to the LPO.� In order to best protect the Government's interests and establish a justification for recoupment of the guaranteed loan through any bankruptcy proceeding, the DOE must establish its outside counsel immediately so that the legal advisor can participate in all analysis and advice that are expected to commence no later than February 15, 2020.� An award to any other law firm would be impractical as a new firm would require a steep learning curve to acquire the knowledge and understanding of the Project and of the situation with the Project. �Clifford Chance is the only firm in the position to provide this requirement. DOE LPO requires the services of Clifford Chance immediately in order to provide legal review, analysis, advice, and action.� LPO requires these services in order to protect its interest vis-a-vis the Project. �Any delay in acquiring the service will delay the DOE's response in protecting its investment of �taxpayer funds. �Clifford Chance is currently the outside legal advisor to the DOE for the Project and has been providing independent advice concerning this Project.� Clifford Chance has deep knowledge of the Project, and is a responsive and responsible contractor. �With this knowledge and available key staffing, Clifford Chance is the only firm poised to perform this effort immediately. THIS IS A NOTICE OF INTENT AND NOT A REQUEST FOR COMPETITIVE PROPOSALS. NO SOLICITATION IS AVAILABLE FOR THIS REQUIREMENT. � If a firm believes the DOE should not pursue this sole source award with Clifford Chance, then they should submit a written capability statement and pricing information for the requirement by 8:30 am local prevailing time (Washington D.C.), January 30, 2020� to Teresa.Brown@hq.doe.gov.� A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information will normally be considered solely for the purpose.
