- Page 1 of 4DEPARTMENT OF VETERANS AFFAIRSJustification and Approval (J&A) ForOther Than Full and Open Competition VAAR 819-7007Acquisition Plan/PR Number: 8990-000001Contracting Activity: Department of Veterans Affairs, National Cemetery Administration, Pacific District Office, National Memorial Cemetery of the Pacific.Nature and/or Description of the Action Being Approved: This is a base plus four one year options, firm fixed price contract that is needed to fulfill security requirements for National Memorial Cemetery of the Pacific. The requirement will be fulfilled per the specifications of the SOW as outlined in the contract.Description of Supplies/Services Required to Meet the Agency s Needs:Contractor to provide security requirements for National Memorial Cemetery of the Pacific.SCHEDULE OF PRICESStatutory Authority Permitting Other than Full and Open Competition:41 USC �3304(a)(5), 38 U.S. Code � 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below:( X ) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or( ) 819.7008 Sole source awards to a verified veteran-owned small businessDemonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):This decision meets the requirements of VAAR 819.7007. The authority allows a sole source award to a SDVOSB based on 38 U.S.C. 8127(c) and the CO has determined that the Arekat Pacific Security, Inc, an SDVOSB vendor, is a responsible source with respect to performance. The CO has determined that the vendor meets eligibility requirements in 819.7003.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies:The CO checked VIP to determine any local vendors available to perform the project. VIP revealed one vendor, Arekat Pacific Security, Inc. The vendor provided a quote that was under the IGCE value and because of this reason, the requirement was sole sourced to the SDVOSB vendor located in Hawaii, Arekat Pacific Security, Inc.Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The quote received from Arekat Pacific Security, Inc in the amount of$1,559,542.80 is less than the IGCE amount of $1,790,951.40. The CO also compared the quote from Arekat Pacific Security to the incumbent s current contract amount of$1,577,025.93 and found the amount to be within a reasonable range, and lower in price.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:Per Far Part 10, the CO searched www.VIP.gov and www.SAM.gov for SDVOSB s that are located near the cemetery. Arekat Pacific Security, Inc met the eligibility criteria outlined in VAAR 819.7003, verification in VIP and the action is below the $5 million threshold.Any Other Facts Supporting the Use of Other than Full and Open Competition: The CO checked the FAPIIS past performance of Arekat Pacific Security Inc and found no negative reports, deeming them acceptable.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:Guard Force International (incumbent) Arekat Pacific Security Inc (Prospective)A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:There are no barriers for future competition of the required acquisition.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.Amy D.
