Description
This is a Pre-solicitation Notice for a proposed contract action, not a request for quotations (RFQ). The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) intends to negotiate on an other than full and open competition basis with Newport-Spectra Physics Laser to procure one (1) year of maintenance for several Newport-Spectra confocal microscopes equipped with Mai Tai lasers. Lasers must be recalibrated and repaired timely in order to support ongoing research. Due to heavy usage and reliance on these microscopes for research, the lifespans of these microscopes and lasers are limited and must be repaired, recalibrated and returned to operation as soon as possible. Newport-Spectra Physics is the sole manufacturer of these microscopes and the sole provider for the parts and software for these instruments. Direct maintenance from the vendor is also necessary in order to optimally install and maintain parts, and to provide technical support compatible with these microscopes.The statutory authority for this sole source requirement is 41 U.S.C. 253(c)(1) as implemented by FAR 6. 302-1 only one responsible source and no other supply or service will satisfy agency requirements. THIS IS NOT A REQUEST FOR QUOTATIONS (RFQ). All responsible sources that can provide services/supplies may submit a capability statement that will be considered by email (subject line to reference NIAID-NOI20-1992609) to Julie Yun at julie.yun@nih.gov by 8:00AM EST Wednesday, November 27, 2019. All responses that meet the agency requirement and are received by the closing date of this Notice will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the GovernmentSPECIAL NOTICEOfferors are advised that the Government may share your information with non-government personnel who are assisting with the evaluation of responses. The exclusive responsibility for source selection will reside with the Government. By submitting your response, you consent to disclosure of your offer to non-government personnel for purposes of evaluation.
