- SOW Instructions to Offerors Combined Synopsis/Solicitation DTFR53-20-Q-000001 11/05/2019 This Combined Synopsis/Solicitation is for Outside Legal Counsel Support to the Office of the Chief Counsel at the Federal Railroad Administration (FRA), Department of Transportation (DOT). Solicitation DTFR53-20-Q-00001 is being issued as a Request for Quotation (RFQ). Synopsis: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subparts12.6 and 13.5, supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and written solicitation will not be issued. This solicitation includes the incorporated provisions and clauses in effect through Federal Acquisition Circular 2019-06. The North American Industry Classification System (NAICS) Code for this procurement is 541110 with a size standard of $11 million; the Product Service Code (PSC) is R418. The Federal Railroad Administration seeks to acquire contract legal services related to Federal Railroad Administration (FRA) actions in connection with the mortgage between the National Railroad Passenger Corporation (Amtrak) and FRA, dated December 9, 1976, as amended (Federal Mortgage) and the accompanying note also dated December 9, 1976, as amended, the easement between Amtrak and FRA, dated October 17, 1978 and the Declaration of Covenants, Conditions, Charges and Restrictions for North East Corridor Maintenance between Amtrak and FRA, dated October 27, 1976, the security agreement and note by Amtrak, dated October 5, 1983, and related documents, each as applicable, (together the "Federal Documents"). Offerors will advise and represent FRA with respect to the above documents on transactions such as that described immediately below and on other matters related to the above documents as required. Refer to the attached Statement of Work for period of performance and deliverables. The following Federal Acquisition Regulation (FAR) provisions and clauses apply to the solicitation: 52.212-1 Instructions to Offerors-Commercial Items; 52.212-2 Evaluation-Commercial Items; 52.212-3 Offeror Representations and Certifications -- Commercial Item; 52.212-4 Contract Terms and Conditions - Commercial Items, 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items; 52.203-98 Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements and 52.204-7 System for Award Management. Interested offerors are reminded that award can only be made to a contractor that is registered in accordance with FAR 52.204-7 System for Award management (SAM). Additionally, in accordance with FAR 12.302, the FAR Clause at 52.212-1 is tailored to include the following statement: The FRA anticipates awarding a labor-hour type contract with a 24-month period of performance. Interested parties capable of providing the specified services shall prepare their quotation in accordance with the attached "Instructions to Offerors" and "Statement of Work", dated, 10/29/2019, and submit to the Contracting Officer, Isaac Rosier, Jr., at os-counsel20Q1@dot.gov. Offerors shall submit a Technical Quotation and a Labor Hour Price Quotation with the Direct Labor Categories and associated fully-loaded Direct Labor Rates to support the SOW effort. Award will be made on a best-value basis. The evaluation factors are Technical Approach, Key Personnel, Past Performance/Experience and Price (direct labor rates). The technical proposal shall address each factor separately and shall conform to the requirements in the Instructions to Offerors. Offerors are encouraged to direct any questions the Contracting Officer by e-mail. No telephone inquiries will be accepted. Questions regarding this combined synopsis/solicitation shall be submitted to the email address below no later than Thursday, 11/14/2019 at 2:00 P.M. EST. Any questions received after this date and time may or may not be answered. Answers to questions will be posted within two (2) business days. Quotations are due on Thursday, 11/21/2019 at 2:00 PM EST and should be submitted via email to os-counsel20Q1@dot.gov. Partial proposals will not be accepted for this requirement.
