Description
USACE Jacksonville District intends to award a contract to implement additional features identified for the Rio de le Plata Project. These additional features consist of (1) the addition of riprap keys and (2) additional riprap armament of the channel upstream and downstream of the Dorado Bridge at the Rio De La Plata - Flood Control Project, Dorado Bridge Channel Widening and Scour Protection (CWSP), Dorado Bridge, in Puerto Rico. Negotiations to be conducted solely with Construcciones Jose Carro SE, under the statutory authority permitting Other than Full and Open Competition, 10 U.S.C. 2304(d)(1)(B), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. Construcciones Jose Carro is the current contractor performing construction work under Contract No. W912EP17C0050 for Rio de La Plata - Flood Control Project, Dorado Bridge, Channel Widening and Scour Protection (CWSP), Dorado, PR. The additional features were not included in the original design and referenced contract and will therefore be funded under the Bipartisan Budget Act of 2018 (P.L. 115-123) (BBA) using Supplemental funds. The proposed features would be constructed by Construcciones Jose Carro under a separate construction contract beyond the original design, which was funded using regular appropriated, cost shared funds. This will allow Jacksonville District to adhere to fiscal law which requires additional work above and beyond what was included in the original design using regular appropriated funds be fiscally tracked separate when using BBA18 Supplemental funds. Fiscal law prohibits mixing regular appropriated funds and supplemental funds under one contract. Most importantly, by having the current contractor perform the channel armament which includes, stone keys at the bottom of the channel slopes and stone protection in the bottom of the channel, the stone would be placed in the dry while the contractor excavates the channel in phases. Also, if the additional channel armament is not aligned to be constructed with the current construction contract then: (1) much of the riprap placed along the channel slopes in the CWSP Contract will have to be removed to place the stone key, thereby reinstalled, (2) all the excavation and stone placement will have to be performed under approximately 20 feet of water with the use of divers, and (3) the underwater placement of stone requires that the riprap thickness and excavation be increased by one and a half times to compensate for the difficult nature of underwater placement. The increase in excavation and stone key would also pertain to the placement of the already placed stone in Contract CWSP that will have to be removed to construct the stone key. This notice is not a request for competitive quotes or proposals. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. The information submitted must be provided in sufficient detail to demonstrate the vendor's ability to fulfill this requirement. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this requirement on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Verbal communications are not acceptable in response to this notice. Responses to this notice are due by 2:00 PM Local Time, 8 November 2019.
