This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued. This solicitation number is 36C25020Q0071 a request for quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2019-06. The associated North American Industrial Classification System (NAICS) code for this procurement is 339112 with a small business size standard of 1,000 employees. This is a Small Business set aside. The Cleveland VA Medical Center, 10701 East Blvd., Cleveland, OH 44106-1702 is seeking to purchase EV1000 Clinical Platform. The equipment shall be brand name. The EV1000 system assists the clinician in assessing the patient s status and supports clinical decisions related to the optimization of oxygen delivery through the management of preload, after load, and contractility. In addition, the EV1000 can assess extra vascular lung water (EVLW) as an indicator of pulmonary edema. Offerors will be evaluated utilizing Lowest Price Technically Acceptable to the Government. Award shall be made to the lowest offer whose quote is the best value to the government, considering technical capability, past performance, and price. The government will evaluate information based on the following evaluation criteria: technical capability factor past performance, and price. The government intends to award a contract as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein. The Contractor shall be an Original Equipment Manufacturer (OEM) authorized dealer, authorized distributor, or authorized Contractor reseller for the proposed equipment/system such that the OEM warranty and service are provided and maintained by the OEM. All warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. The Contractor shall provide new items ONLY; no remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The EV1000 is a monitoring platform that displays both intermittent and continuous hemodynamic measurements related to the assessment of the essential components of oxygen delivery as well as the balance of oxygen delivery against consumption. The EV1000 system assists the clinician in assessing the patient s status and supports clinical decisions related to the optimization of oxygen delivery through the management of preload, after load, and contractility. In addition, the EV1000 can assess extra vascular lung water (EVLW) as an indicator of pulmonary edema. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Surgical Intensive Care Unit (SICU) of the Wade Park campus already has two of these devices. This request is for the purchase of additional units for exact match and continuity purposes at the Wade Park Campus. There is a shortage of these devices in the medical center and in the current situation, the Anesthesiology Service finds itself frequently borrowing these devices from SICU in order to monitor vascular patients during surgery. The Anesthesiology Service is requesting to acquire one of these devices in order to reduce the need to borrow from the SICU. Description of market research conducted and results or statement why it was not conducted: Market research was conducted on GSA, VA NAC, AbilityOne, UNICOR, and VIP. The Vetbiz search using NAICS Code 339112 and keywords Edwards Lifesciences revealed one SDVOSB source. The 1st American Medical Distributors (1AMD), Inc., is the exclusive authorized federal distributor of Edwards Lifesciences products and services. 1AMD receives OEM direct prices and are authorized to negotiate on behalf of Edwards Lifesciences. 1AMD is fully trained with Edwards Lifesciences products. Additionally, due to the non-manufacturer rule, the SBA Class Waiver List was reviewed and found that there is no waiver for NAICS Code 339112 and PSC 6515. Based on the NMR and OEM authorized distributor list, the Rule of Two cannot be met. Edward Lifesciences only has one small business distributor. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
