Description

The Department of Veterans Affairs, Network Contracting Office (NCO) 22, is issuing this Notice of Intent (NOI) to inform industry contractors of the Government s intent to execute a Sole Source award under FAR Part 13 Simplified Acquisition Procedures (SAP), specifically FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items with Siemens Medical Solutions USA, Inc. located at 40 Liberty Boulevard. Malvern, PA. 19355 This requirement will be used for Annual Syngo Dynamics Software License and Support Service for the VA Greater Los Angeles Healthcare System (VAGLAHS), located at 11301 Wilshire Blvd. Los Angeles, CA. 90073. The Engineering Section at VA Greater Los Angeles Healthcare System requires Annual Software Licensing and Support Services of the Government-Owned Syngo Dynamics DL Server located at the facility. The services provided include a perpetual annual license and extension of software support. The contractor shall provide application support via the following tasks: Correct any failure of the Application to perform substantially in accordance with respective documentation. Provide 24/7 access to Siemens Customer Care Center (CCC) through Siemens LifeNet System. Initiate work on urgent issues within 1/hr. of request for assistance via the CCC. Provide periodic updates and release to the Applications during the Warranty Period and for support fees and documentation of the items at no additional license fee. The Contractor shall furnish all labor, materials, travel, lodging and any other supplies or equipment necessary to perform the requirement. The contractor shall provide the following deliverables: Perpetual License and Support Service. The estimated value of the Base Year is $57,966.00, with a total estimated value of $173,988.00 for the life of the contract. This procurement is being conducted using commercial item procedures pursuant to FAR Part 12 and FAR Part 13, specifically FAR Subpart13.106-1(b)(1)(i) allowing the Contracting Officer (CO) to solicit from one source based on the determination that Siemens Medical Solutions USA, Inc. is the sole manufacturer and provider of the Syngo Dynamics software and servers. With respect to software, Siemens does not permit any third-party software to run on its machines for image acquisition purposes. The software purchased pursuant to this procurement is proprietary software of Siemens and its affiliates, and as a result Siemens is the sole provider of those software licenses. This will be a Firm Fixed Price (FFP) award and an anticipated award date is set for 11/1/2019. The place of performance is as follows: VA Greater Los Angeles Healthcare System (VAGLAHS), located at 11301 Wilshire Blvd. Los Angeles, CA. 90073. The North American Industry Classification System (NAICS) for this requirement is, 511210 Software Publishers. The Small Business Administration size standard is $38.5 Million. This notice of intent is neither a formal solicitation nor a request for competitive proposals. No solicitation document is available and telephone requests will not be honored. No award will be made on the basis of unsolicited quotations or offers received in response to this notice. Any response to this notice must show clear, compelling and convincing evidence that competition will be advantageous to the Government. The intent of this synopsis is for informational purposes only. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government.
