- Redacted J&A The Naval Air Systems Command (NAVAIR) awarded a cost-plus-fixed-fee (CPFF) delivery order for the procurement of supplies and engineering services in support of Navy P-8A Poseidon Flight Test Aircraft. Tasking will consist of performing activities required to support Government flight operations on the P-8A flight test aircraft and the Patuxent River Naval Air Station System Integration Lab (PAXSIL). The effort was procured pursuant to 10 U.S.C. 2304(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements." The Boeing Company (Boeing) is the original designer, developer, and manufacturer of the P-8A and its sole integrator. The test aircraft are outfitted with test instrumentation installed by Boeing. Aside from the configuration and non-commercial and commercial technical data associated with each aircraft excluding the test instrumentation, the Government does not possess any technical data associated with the test instrumentation nor can the Government acquire the necessary data. It was determined that a CPFF contract action was the appropriate contract type pursuant to DFARS 235.006(b)(ii) (A). This is a development program for which the use of a fixed-price type contract would not provide an equitable and sensible allocation of program risk between the Government and the Contractor due to the uncertainties related to the Increment 3 requirements.
