Dollar Value: JUSTIFICATION REVIEW DOCUMENT FAR 8.405-6 LIMITED SOURCES JUSTIFICATION UNDER THE GENERAL SERVICES ADMINISTRATION FEDERAL SUPPLY PROGRAM 1. Contracting Activity: Mission and Installation Contracting Command - (MICC-Ft Lee), 1830 Quartermaster Road, Bldg. 7124, Ft Lee, VA 23803-1205. 2. Description of Action: Project Directorate (PD), Army Logistics and Technology Enterprise Systems and Services (ALTESS) seeks the procurementof Preventive Maintenance (PM) and Emergency Repair Services (ERS) for Trane Chillers supporting the PD ALTESS data center. PM& ERS is vital to ensuring the chillers remain fully operational around-the-clock to provide cooling for vital computer equipment and facilities. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B). 3. Description of Supplies/Services: The procurement of Preventative Maintenance (PM) & Emergency Repair Services (ERS) for chillers provides around-the-clock maintenance support for Trane Chillers that support the PD ALTESS data center. Preventive Maintenance services provided by Trane ensures that all the chillers supporting the data center are properly serviced to prevent wear and tear on pumps, drive belts, motors, piping, monitoring systems, software and various other keys pieces of internal equipment to maintain functionality. Emergency Repair Service provided by Trane US, Incorporated helps ensure the chillers have the necessary emergency support whether it may be during duty hours or after hours. 4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (41U.S.C. 251, et. Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by FAR 8.405-6 and substantiated by FAR 8.405-6(a))1)(i)(B) only one source is capable of supporting this service. 5. Reason for Authority Cited: Restricting consideration to an item peculiar to one manufacturer. Restricting this procurement to Trane US, Incorporated is essential in meeting the agency's requirement and to remain compliant with the initial commercial product warranty of Trane equipment currently already in use. Trane US, Incorporated is currently the only authorized provider whom can perform the upgrade. By Trane US, Incorporated performing this service, the current warranties and/or compatibility of equipment will remain unchanged and uninterrupted during services. Trane US, Incorporated has identified that they do not have any other authorized reseller or contractor that can perform these types of services. 6. Actions to Increase Competition: Effective Competition: In accordance with FAR 5.202(a)(11), the proposed contract action is made under the terms of an existing Indefinite Delivery/Indefinite Quantity contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207 with respect to the current proposed Control No: 12-2019-W91QF5 Program/Equipment: PM& ERS for Chillers Est. Dollar Value: contract action. Consequently, pursuant to FAR 8.404(a), orders placed against a Multiple Award Schedule (MAS) are considered to be issued using full and open competition. Therefore, when placing orders under a Federal Supply Schedule (FSS), ordering activities shall not seek competition outside of the FSS or synopsize the requirement. Secondly, the Government will continue to conduct market research to ascertain if there are any changes in the market place that would enable future actions to be completed. 7. Market Research: Market research, was conducted by the requiring activity during the period of 18 February 2019 through 1 March 2019, to determine the availability of preventive maintenance an emergency repair services for chillers. After further research, it was determined Trane U.S. Inc., was the only authorized service provider to support the requirement for PM & ERS of Trane chillers. Trane US, Incorporated is able to provide the PM& ERS for Chillers under their respective GSA FSS contract vehicle (GS-06F- 0079R). Additional, market research was conducted and consisted of various searches on the internet. See market research report dated 13 September 2019 for further details. In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a sources sought/Request for Information was posted to Federal Business Opportunities (FedBizOpps) on 04 September 2019 for seven (7) calendar days; closing on 11 September 2019/noon. No other firm showed interest in this requirement. (See attachment 5) A Notice of Intent to issue an award to a single source in accordance with FAR 6.302- 2 for an initial performance period of 12-month base year with four (4) (12)-month options years will be publicized on Federal Business Opportunities (FBO) website on or about 13 September 2019 with a closing date of 17 September 2019. Due to the proprietary nature of the requirement, no other vendor will be able to provide the required maintenance without the risk of voiding the warranties. (See attachment 6) 8. Other Facts: Procurement History Contract number: W91QF5-15-F-0029 Contract Awardee: Trane U.S. Inc. Description of requirement: Chiller Maintenance Method of procurement: FAR 8.405-6(a) only one source is capable. Dollar Value: Other Facts: Option year 4, was declinated as the previous chiller requirement did not have several major components to support an effective maintenance support under one contract. The change in scope required an entirely new requirement to add in the missing components under one contract. 9.
