- Page 1 of 9 Revision 08 Date: 04/18/2018 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 36C252-19-AP-3421 Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 115 S. 84th Street, Milwaukee, WI 53214. Transaction 695-20-1-6134-0001. Nature and/or Description of the Action Being Processed: This procurement is for preventative maintenance on the nurse call system to include updates/upgrades to the proprietary software in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. This new contract action will be, awarded on a firm-fixed price basis and includes a 12-month base period of performance with three 12-month option periods. Description of Supplies/Services Required to Meet the Agency s Needs: The Clement J. Zablocki Medical Center has a requirement to maintain and upgrade the nurse call system. These services are critical for patient care, as the nurse call system is a vital link between patients and nursing staff. Service includes emergency and non-emergency updates and upgrades to the systems software. Total estimated value (base and three options): $679,500.00.00 Base period of performance: 10/1/2019 9/30/2020 Statutory Authority Permitting Other than Full and Open Competition: This acquisition is conducted under the authority of 41 U.S.C. 1901 Simplified acquisition procedures as implemented in FAR 13.501. Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Services include software updates and upgrades to the proprietary software currently supporting the nurse call and code blue systems. The vendor must be able to install all updates and upgrades as required/needed by the system. Due to proprietary software, no other vendors are able to access the software. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The Contracting Officer conducted market research with VIP, SBA, GSA, FBO, FPDS and the internet for sources however, none were identified that could perform the service. A notice of intent to sole source to Systec Limited was posted to FBO from 9/6/19-9/12/19 however no responses were received. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost will be considered fair and reasonable based on comparison with historical contract VA69D-15-C-0276 and the IGCE. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The Contracting Officer queried the Veterans Information Pages (VIP) in accordance with the VAAR Class Deviation 810.001-70 to determine if two or more service-disabled veteran-owned small businesses were listed. No vendors were identified that could service the Wisconsin area. Searched SBA for any current 8(a) certified businesses, veterans disadvantaged businesses, service disabled, and women owned businesses, no firms were found. Conducted an internet search, FBO, GSA and FPDS search with only Systec as a viable vendor. As described in Section 6 above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. Any Other Facts Supporting the Use of Other than Full and Open Competition: The nurse call system was installed as part of a construction project. Since the original installation the system was expanded due to patient care area renovations. Installing a completely new system would not be cost effective. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Systec LTD of Wisconsin Inc, 12645 W. Burleigh Rd #10, Brookfield, WI 53005-3102. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There is only one source for the required maintenance service of the nurse call system. The Contracting Officer will continue to conduct market research and synopsize future requirements for these same services to see if any additional vendors can provide these services to the Government. In addition, the Government will consider including a maintenance agreement in any subsequent equipment replacements.
