Description
Background: The U.S. Nuclear Regulatory Commission (NRC), Office of Nuclear Material Safety and Safeguards (NMSS) is responsible for regulating activities which provide for the safe and secure production of nuclear fuel used in commercial nuclear reactors; the safe storage, transportation and disposal of high-level radioactive waste and spent nuclear fuel; and the transportation of radioactive materials regulated under the Atomic Energy Act. NMSS ensures safety and security by implementing a regulatory program involving activities including licensing, inspection, assessment of licensee performance, events analysis, enforcement, and identification and resolution of generic issues. Leidos Innovations Corporation ("the Contractor") provides the NRC with comprehensive user support, system maintenance, regulatory compliance and hosting services to support user communities relying on NRC's Integrated Source Management Portfolio (ISMP) systems. These users range from various NRC offices, Agreement State agencies, and thousands of licensees that must comply with regulations requiring reporting to ISMP systems. These support services are essential in sustaining responsive support for licensees required to report to ISMP component systems as well as for other mission support functions, including event response. Need for Noncompetitive Modification: The NRC intends to solicit, negotiate and award a modification to increase the maximum value of Indefinite-Delivery, Indefinite-Quantity Contract No. NRC-41-10-017 with Leidos Innovations Corporation, 700 N Frederick Ave, Gaithersburg, Maryland. The current maximum value is $77,439,634.37; the intent is to increase the maximum value to $87,127,134.30. The statutory authority for this action is 41 U.S.C. 3304(a)(1), as implemented in Federal Acquisition Regulation (FAR) 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. This modification is necessary to allow for the completion of migration of ISMP cloud hosting to a NRC-managed cloud infrastructure, including any required ISMP cloud infrastructure configuration changes to efficiently integrate with the NRC-managed Cloud infrastructure. Additionally, several ISMP modernization projects must be completed without disruption by the end of FY2021. These include implementation of the following: an interface between the ISMP Web-Based Licensing System (WBL) and the NRC Agencywide Documents Access and Management System (ADAMS) document management system; a web-based interface allowing parties to apply for any of the license types supported within ISMP/WBL; a new ISMP/WBL interface to allow Agreement State licensee direct upload of International Atomic Energy Agency (IAEA(Category 1 and 2 byproduct materials licenses required for 10CFR37 validation; an interface to allow direct upload/entry to the WBL General License tracking module of required inventory reports; and Integration of the WBL Sealed Source and Device module data into the Materials list for applicable byproduct materials licenses under 10 CFR 30. Concurrent with these modernization and enhancement activities, the NRC will need to maintain and operate the steady state ISMP systems and associated regulatory compliance reporting services. This ongoing operational mission support includes but is not limited to the National Source Tracking System (NSTS) Annual Inventory Reconciliation and timely processing of routine daily transactions in compliance with 10 CFR 20 and NRC commitments to the IAEA Code of Conduct. Even if another contractor could potentially become proficient in supporting NRC's ISMP systems, it is impractical to do so given the future NRC plans to support the ISMP requirements by competing a BPA Call among NRC's GLobal INfrastructure & Development Acquisition (GLINDA) GSA Federal Supply Schedule Blanket Purchase Agreement (BPA) awardees. The intended noncompetitive modification will enable the NRC to ensure the continued operational stability of ISMP and ensure that a smooth transition takes place under the FY 2020 competitive GLINDA BPA Call replacement acquisition.
