- This notice of intent is not a request for proposals or quotations. The authority for negotiating a sole source basis is made under FAR 13.106-1(b) which permits soliciting from a single source if the contracting officer determines that the circumstances of the contract action deem only one source is reasonably available. Any challenges to this sole source requirement must be received by September 12, 2019 NO later than 10:00 AM Washington D.C. local time, in writing, and sent to Nereyda.Dunn@fcc.gov in order to be considered by the Government for the purpose of determining whether or not to compete the requirement. Challenges must include information sufficient to enable the Government's needs as stated herein. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. American Industry Classification System (NAICS) code for this acquisition is 517311 (Wireless Telecommunications Carrier) with a small business size standard of 1,500 employees. The FCC performed an analysis of the features of various commercial and public speed test datasets to determine the feasibility of using a source other than the Ookla Speedtest Intelligence product. While several of the dataset products reviewed include the required raw measurements for both mobile and fixed speed tests in the U.S. and OECD countries, the Ookla Speedtest Intelligence dataset is the only product with sufficient number of measurement samples for the Commission's needs. In particular, the Ookla Speedtest Intelligence data contains significantly more measurements, including many in less densely populated areas in the U.S., which allows for the required statistically sufficient analysis of broadband speeds. Given the data analysis requirements of the Commission's statutorily-mandated broadband reports, staff has concluded that the Ookla Speedtest Intelligence data is thus the only product currently available that satisfies all essential requirements.
