REQUEST FOR QUOTE #75H71319Q00011 DEPARTMENT OF HEALTH & HUMAN SERVICES PORTLAND AREA INDIAN HEALTH SERVICE WESTERN OREGON SERVICE UNIT BEHAVIORAL HEALTH PROGRAM FOR POSITIVE YOUTH DEVELOPMENT - HEALTH, NUTRITION, AND FITNESS PROGRAMS (i)This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in subpart 12.6 of the FAR and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; your quotes are being requested and a separate written solicitation will not be issued. (ii)Solicitation number 75H71319Q00011 applies, and is issued as a Request for Quotes (RFQ). (iii)This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2019-01. (iv)This requirement is a total Small Businesses set-aside and the associated NAICS is 624190 with small business size standard of $11.0M. See 25 U.S.C. 47 and HHSAR Subpart 326.6 - Acquisitions Under The Buy Indian Act, for the details. (v)See the Additional Terms and Conditions - II Payment Schedule, for the pricing structure for estimated quantity hours and unit price for a total price. This is a firm price contract; Base year, plus four (4) one year option years. (vi)This firm fixed price contract is to provide the IHS with highly skilled, knowledgeable and professional support resources who shall and produce a wellness program for positive youth development to include health, nutrition, and fitness programs in support of the IHS mission to raise the physical, mental, social, and spiritual health of American Indians and Alaska Natives to the highest level. The Contractor staff shall be proficient in various specialized applications to be performed and must be certified. See the attached Terms and Conditions. (vii)Delivery and acceptance terms for this order, when applicable, is FOB Destination. (viii)The provision at 52.212-1, Instructions to Offerors - Commercial Items (Oct 2018) applies to this acquisition. STATEMENT OF WORK: SERVICES AND PRICE/COSTS: I.OBJECTIVE OF CONTRACT: A firm fixed priced service contract will be awarded for the Western Oregon Service Unit, Behavioral Health Program for Positive Youth Development (PYD)- Health, Nutrition, and Fitness Programs for patients residing at the Chemawa Indian School. II.PAYMENT SCHEDULE: The hourly rate awarded is the contract price for services that covers all related costs to provide services on-site. This rate will be a burden rate and no other fees will be added to this contract. The current number of registered patients is 18,200 with 6,000 active patients using the clinic. The center provides student school health services for the Chemawa Indian School, located in Salem, Oregon. The facility provides approximately 32,100 ambulatory patient visits per year. There are two full-time physicians and one full-time nurse practitioner. There are same day appointments in the Medical department for: oPrimary and well child care oPrenatal and post-delivery care oFamily planning (birth control) oMinor surgical and orthopedic care The clinic is located behind the Chemawa Indian High School at 3750 Chemawa Road, NE Salem, Oregon 97305 II.PURPOSE To provide PYD Health, Nutrition, and Fitness Programs during the school year. The purpose of the work is to improve the overall mental and physical health status of the CHS eligible Native American/Alaska Native boarding school patient population served. Most contacts are with patients receiving care at the Chemawa Bureau of Indian Education under the operating parameters of the IHS/BIE Memorandum of Understanding (MOU). The primary purpose of direct patient contacts is to provide a comprehensive array of culturally relevant public health prevention Positive Youth Development (PYD) Health, Nutrition, and Fitness Programs that reduce risk factors facing American Indian and Alaska Native Youth and promote resiliency, health, and wellness for youth that attend the Chemawa Indian High School. III.DELIVERABLES/GENERAL PROVISIONS A.The Contractor shall provide qualified health, nutrition, and fitness professionals that adhere to recognized best practice standards of care in health, nutrition, and fitness programs for adolescent youth. Programs and services are scheduled with the Behavioral Health Director and/or designee, not to exceed 8,333 hours per year and 8,333 hours per year thereafter. For planning purposes, there should be no more than twelve (24) students per group for group services. This requirement will be considered met if all students were seen that were scheduled as a part of the Public Health, Nutrition, and Fitness Prevention Planning/Program priorities. The contractor shall provide health, nutrition, and fitness public health practitioners with specialized training, licensure and/or certification in the requested specialty at WOSU for the benefit of adolescents that attend the Chemawa Indian Boarding School. Services will be scheduled by the WOSU Public Health Nurse in consultation with the clinic Medical Director and Director of Nursing during operating hours of 7:30am to 7:30pm, up to 7 days a week. Scheduled work hours will be based on highest level of need, to include day time, evening, and/or scheduled weekend programs/services. Monthly scheduled hours will not exceed 8,333 hours per year. B.The clinic is not open on federally recognized holidays or certain day(s) of closure pursuant to an Executive Order by the President of the United States. Inclement weather conditions or facility issues (electrical, water, etc.) may also hinder the normal operating hours and notice of closure will be provided as soon as is practicable by the Project Officer or the Western Oregon Service Unit administrative component. ` C.Contractor shall provide credentialed health, nutrition, and fitness practitioners with specialized training and experience in adolescent public health prevention and wellness School-Based Health and Wellness Programs. The designated health, nutrition, and fitness provider programs will largely take place under the IHS/BIE MOU to provide the optimal access to integrated school-based public health and wellness programs within a school-based setting. The Health, Nutrition, and Fitness program coordinator will be available throughout the full continuum of scheduled programs and supervise the designated Health, Nutrition, and Fitness providers. PYD Health, Nutrition, and Fitness Programs are to be provided to PRC eligible students of the Chemawa Boarding school who report and/or indicate any risk factors for Physical Health, Substance Abuse, Mental Health, Trauma, Suicidal Ideation, and other social determinant risk factors that would place the youth at higher risk for physical health, substance abuse and/or mental health issues. D.(PYD) Health, Nutrition, and Fitness Programs promote physical and mental well-being through learning how to eat right, importance of physical fitness supporting mental fitness, being active and practicing good hygiene, and basic health principles and practices that can support life- long wellness, reduce adverse childhood event risk factors, and promote social well-being. Secondary program focus is on developing and strengthening communication and problem-solving skills, emotional regulation, conflict resolution, help seeking and coping skills directed at reducing risk and promoting resiliency in addressing alcohol, tobacco and drug use prevention, sexually transmitted disease, sexual health, bullying prevention, promotion of mental health, and suicide prevention. PYD - Health, Nutrition, and Fitness Programs along the public health continuum have been proven to support both physical, mental health, and human development needs including both physical and behavioral health wellness. This may include and not be limited to: Sexual Health, Intimate Partner Violence, Adverse Childhood Events/PTSD, substance abuse, eating disorders, diabetes, depression, anxiety, relationship problems and communication needs. PYD Health, Nutrition, and Fitness Programs will focus on both physical and emotional well-being, facilitating positive peer relationships and supports, learning that fosters self-esteem and self-worth, educational, physical, and/or psychological goals aligned with Western Oregon Service Unit Public Health and Behavioral Health Service Delivery priorities. Programs will be provided to promote life-long wellness, resiliency, and positive social skills building within the social and natural environment. All designated providers may be required to act within an integrated treatment team, support care coordination functions, maintain CNACI clearance, and secure E.H.R access as needed to document services, and support quality management practices that document and monitor program outcomes. E.Contractor must be able to be qualified and privileged through WOSU process as appropriate. F.Contractor shall maintain their own continuing education requirements necessary for licensure and/or ongoing training and development to maintain best practices in behavioral health prevention. G.Contractor shall be responsible for recording all patient care programs and services in appropriate health records in compliance with the WOSU clinic standards. H.The Contractor shall be responsible for applicable state and local sales or other taxes as required, except as provided by the Government, to provide professional practice services as outlined above to eligible beneficiaries. Eligible beneficiaries are defined by the policy and procedures of the WOSU. I.The Contractor shall provide proper and adequate services in accordance with the Standards of Care established by recognized health care organizations including those of the Indian Health Service. All services shall be provided within accepted professional standards and be consistent with AAAHC accreditation and state certification requirements. DELIVERIES AND PERFORMANCE I. PERIOD OF PERFORMANCE AND LOCATION: PYD Health, Nutrition, and Fitness Programs under this contract will be performed at the following location: PYD HEALTH, NUTRITION, AND FITNESS PROGRAMS Western Oregon Service Unit 3750 Chemawa Rd NE Salem, OR 97305 BIE Chemawa Indian High School 3700 Chemawa Rd NE Salem, OR 97305 Worked performed shall be between the hours of 8:00 am to 5:00 pm In accordance with the statement of work, for the period of TBD, 2019 through August 30, 2020. There are potentially four (4) one-year option years subject to negotiations and availability of funds. II.INDIAN HEALTH SERVICE RESPONSIBILITIES: A.The WOSU shall provide an on-going method of monitoring and evaluation of the quality and appropriateness of patient care, and of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. B.Each health care provider shall be provided with a 2 day orientation to the Indian Health Service and the Indian Community being served. The initial orientation and continuing orientation shall be provided by the WOSU personnel. C.The WOSU will be responsible for informing the Contractor of any facility closure due to conditions described in Section V.C. above as soon as is practicable. Such notification methods shall be mutually agreed upon between the Contractor and the WOSU. D.The on-site contact, Michelle Livingston, Director of Nursing, designated Public Health Nurse, Rachel Taylor, Quality Risk Management Officer will serve as the coordinator of any privileging and/or credentialing packages from the Contractor. The credentialing packages will include the forms to be submitted by the Contractor in Section J. 1.The COR and Contractor will coordinate provider interviews and credentialing packages. 2.Upon selection of a provider, the COR will inform the Contracting Officer by email with: Full legal name, (this may require coordination with the contractor) 3.The Contracting Officer will complete the e-QIP form and submit it to Human Resources (HR) for further processing. 4.HR will initiate the background check with the Office of Personnel Management (OPM) and fingerprint processing upon receipt of the eQIP form. This will require contact between HR and the Contractor. 5.The contractor will coordinate the completion of necessary HR forms between the prospective provider and HR. 6.HR will notify the Contracting Officer when the fingerprints are adjudicated as favorable or unfavorable, with instructions for the provider and the Service Unit. When the background check is complete, a certification will be issued to the provider. 7.The Contracting Officer will notify the COR and the Service Unit of the prospective provider's status. If favorable, the COR shall inform the provider and contractor as well as agree upon a start date. CONTRACT ADMINISTRATION I - INVOICE SUBMISSION Invoices shall be submitted to: Micah Woodard, Contracting Officer Representative (COR) Western Oregon Service Unit 3750 Chemawa Road, NE Salem, Oregon 97305 Invoices are to be submitted monthly. Payment shall be made only for hours actually completed at time of invoice submission. Payment will be made by Electronic Funds Transfer (EFT). The Contractor agrees to include the following information on each invoice: oContractor's Name, Address and Invoice Date oContract Number oContractor's Employer Identification Number (EIN) oDate(s) of session(s) held oNumber of patients counseled, including coordination of care oDescription of cost oTotal amount due Final payment shall be made after: 1.Completion and acceptance of all services 2.Presentation of a properly executed invoice 3.Presentation of "Release of All Claims Against the Government" (PHS-3576). A request for Final Payment on the contract must be accompanied by a completed.PHS-3576, which will be provided by the Contracting Officer. a.The "Final" payment will be rejected and returned to the Contractor if all items required under the contract have not been completed, submitted, or approved. II - ON-SITE CONTACT/SUPERVISION: A.The following individual or their designee shall serve as Supervisor government representative under this contract: Contracting Officer Representative Western Oregon Service Unit 3750 Chemawa Rd. NE Salem, OR 97305 The Supervisor's responsibilities will be to coordinate with the provider the technical aspects of this service and the review of performance hereunder and has no authority to change or alter terms of this contract. B.The following individual shall serve as the Contracting Officer Representative (COR) under this contract: Micah Woodard Phone: 503-304-7626 Western Oregon Service Unit The COR's responsibilities will be to monitor the contract and to coordinate any Contractor requests or service unit contract requests through appropriate steps for a Contracting Officer's action. The COR has no authority to change or alter the order amount, terms or conditions of this contract without the approval of the Contracting Officer. The COR will apply quality control measures for assessing the contract in a meaningful and standardized manner. To be discussed during the pre-award meeting. C.Should additional option years be awarded, increases will be considered on the basis of performance and availability of funds. D.Payment shall be made in accordance with the hourly rate of the contract for services provided at the clinic site. Payment for services received and approved shall be paid at an hourly rate calculated using the actual number of hours services are provided (rounded to the nearest ¼ hour). E.Payment shall be made in accordance with the Prompt Payment Act of 1982, as amended, which states that disbursement will be made within 30 days of an accepted and Approved Invoice by a Contracting Officer when presented to the Finance Office.   SPECIAL CONTRACTOR REQUIREMENTS I.QUALIFICATIONS: A.The contractor shall maintain the following qualifications as a minimum of staff: School Based Health, Nutrition, and Fitness Programs Coordinator: •Be a credentialed Health, Nutrition, and Fitness practitioner within at least one of the below Youth Health and Wellness Specialist •Have three (3) years experience in the development, implementation, and coordination of comprehensive school-based PYD Health, Nutrition, and Fitness Programs •Hold a current, valid, and unrestricted license and/or credential to practice in the United States, the District of Columbia, Puerto Rico, or a territory of the United States; Youth Health and Wellness Specialist may include, but not be limited to: •Meet criteria as a Recreational Therapist (RT): Recreational Therapy Aid (RTA); Registered Nurse (RN); Certified Personal Trainer (CPT); Certified Wellness Coach; Registered Dietician Nutritionist (RDN); Aquatic Therapeutic Exercise Certification (ATRI); Physical Therapist (PT); Physical Therapist Aid (PTA). Other eligible specialty experience in Health, Nutrition, and Fitness programs that hold the following credentials may include, but not limited to Registered Behavior Technician (RBT); Board Certified Assistant Behavior Analyst (BCaBA); Board Certified Behavior Analyst (BCBA); and Board Certified Behavior Analyst-Doctoral (BCBA-D). •Have at least one (1) year of experience providing Health, Nutrition, and Fitness Positive Youth Development Programs; •Hold a current, valid, and recognized Health, Nutrition, and Fitness provider credential, that may include the above referenced Youth Health and Wellness Specialist. Other nationally recognized public health practitioner credentials may qualify upon review and approval by the Public Health Nurse, Medical Director, and Director of Nursing if found adequate to meet the qualification and goals of the program. B.The contractor shall complete, sign and return the forms listed below upon award: •Certification Of Immunization (Attachment A) •Declaration of Employment (Attachment B), (Attachment B-1) •Certification of Education, Licensure and Insurance (Attachment C) •Health Insurance Portability and Accountability Act (HIPAA) Agreement (Attachment D) •Contractor's Release for All Claims (Attachment E) •Electronic Questionnaires for Investigations Processing (eQIP - Attachment F) C.Additional credentialing information may be required at the WOSU. The certifications and other required credentialing information by the contractor shall be consistent with and meet the credentialing and privileging requirements of the WOSU and the Indian Health Service. II.ADDITIONAL SPECIAL CONTRACT REQUIREMENTS: A.The Contractor may suggest an alternate provider(s) during a scheduled absence with the following conditions: 1.A minimum of 45 days notice is given to the WOSU, such notice will include the name and necessary information for credentialing to be confirmed prior to rendition of services. 2.The alternate provider will be considered a sub-contractor to this contract and the payment for sub-contractor services shall be the responsibility of the Contractor. The alternate provider(s) must possess the same qualifications as specified in this contract prior to a scheduled session. Failure to possess or maintain such qualifications, including mandatory clearances shall deem the offeror ineligible for award and cause the contract to become null and void at no cost to the Government. B.Contractor Government Furnished Equipment and Facilities The WOSU does not anticipate a need for contractor furnished equipment other than appropriate music instruments and specialized equipment to support PYD Health, Nutrition, and Fitness Programs. C.HIPAA Requirement Pursuant to the Health Information Portability and Accountability Act (HIPAA) of 1996 and its implementing regulation, the Standards of Privacy of individual Identifiable Health Information at 45 CFR Part 160 and 164, Subparts A and E ("Privacy Rule"), the Indian Health Service is required to enter into an agreement with the Business Associate, pursuant to which the Business Associate shall comply with and appropriately safeguard Protected Health Information ("PHI") that it will use and disclose when performing functions, activities or services ("Services") for the Indian Health Service. The Business Associate Agreement by signing the contract shall comply with the following terms in addition to other applicable contract terms and conditions relating to the safekeeping, use and disclosure of PHI. (See Attachment D for related HIPAA material and Business Associate Agreement Clause). Type of Contract (far 52.216-1)(Apr 1984) The Government contemplates award of a Fixed Price contract resulting from this solicitation. Submit copies of licenses, certifications, etc. to document certification. 3.System for Award Management (SAM): Contractor must complete registration at the website in accordance with clause 52.204-7 before an offeror is eligible for contract award, and must maintain their registration as "active". 4.CPR/BLS Certification: Submit documentation of current certification. 5.Resume, Curriculum Vitae, or other up-to-date documentation indicating past experience and current status of capabilities. Offerors are advised to address the evaluation factors and qualification requirements. 6.Required Documents for Background Investigation (Attached) 7.Relavant Past Performance: Offeror shall submit past performance information on three (3) projects of similar scope and magnitude that were completed as a Prime Contractor within the last three (3) years from the solicitation closing date. Past performance information information must consist of final performance ratings of the project(s) and/or project references who can provide performance assessments. References shall consist of officials from the issuing contracting agency who oversaw the performance of the project. The Government reserves the right to obtain past performance information from other sources such as the references and the Past Performance Information Retrieval System (PPIRS) and other Federal performance assessments systems but is not limited to these sources, pursuant with FAR subpart 42.15. Offerors with no historical record of past performance will receive a Neutral rating. The Government may award this contract to a responsible offeror whose proposal, conforming to the solicitation, will be most advantageous to the Government, with paramount consideration being given to price when proposals are equally ranked. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. (End of Clause) (xiii)52.237-7 INDEMNIFICATION AND MEDICAL LIABILITY INSURANCE (JAN 1997) (a) It is expressly agreed and understood that this is a non-personal services contract, as defined in Federal Acquisition Regulation (FAR) 37.101, under which the professional services rendered by the Contractor are rendered in its capacity as an independent contractor. The Government may evaluate the quality of professional and administrative services provided, but retains no control over professional aspects of the services rendered, including by example, the Contractor's professional medical judgment, diagnosis, or specific medical treatments. The Contractor shall be solely liable for and expressly agrees to indemnify the Government with respect to any liability producing acts or omissions by it or by its employees or agents. The Contractor shall maintain during the term of this contract liability insurance issued by a responsible insurance carrier of not less than the following amount(s) per specialty per occurrence: * $1,000,000.00. (b) An apparently successful offeror, upon request by the Contracting Officer, shall furnish prior to contract award evidence of its insurability concerning the medical liability insurance required by paragraph (a) of this clause. (c) Liability insurance may be on either an occurrences basis or on a claims-made basis. If the policy is on a claims-made basis, an extended reporting endorsement (tail) for a period of not less than 3 years after the end of the contract term must also be provided. (d) Evidence of insurance documenting the required coverage for each health care provider who will perform under this contract shall be provided to the Contracting Officer prior to the commencement of services under this contract. If the insurance is on a claims-made basis and evidence of an extended reporting endorsement is not provided prior to the commencement of services, evidence of such endorsement shall be provided to the Contracting Officer prior to the expiration of this contract. Final payment under this contract shall be withheld until evidence of the extended reporting endorsement is provided to the Contracting Officer. (e) The policies evidencing required insurance shall also contain an endorsement to the effect that any cancellation or material change adversely affecting the Government's interest shall not be effective until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer. If, during the performance period of the contract the Contractor changes insurance providers, the Contractor must provide evidence that the Government will be indemnified to the limits specified in paragraph (a) of this clause, for the entire period of the contract, either under the new policy, or a combination of old and new policies. (f) The Contractor shall insert the substance of this clause, including this paragraph (f), in all subcontracts under this contract for health care services and shall require such subcontractors to provide evidence of and maintain insurance in accordance with paragraph (a) of this clause.
