- This is a combined synopsis/solicitation for commercially available access to an on-line Enterprise-Wide Database Subscription Services for Labor & Employment Practice Center on Bloomberg Law (Bloomberg Bureau of National Affairs (BNA) to the Equal Employment Opportunity Commission (EEOC), items/services and is prepared in accordance with the format in Federal Acquisition Regulation (FAR), Subpart 12.6, as supplemented with additional information included in this notice, herein referred to as Access to an on-line Enterprise-Wide Database Subscription Services. This Notice of intent is not a request for competitive proposals. However, all quotations received by the closing response date will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The proposed contract action is for commercially available supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested parties may identify their interest and capability to respond to the requirement or submit quotation(s). As stated above, this notice of intent is not a request for competitive quotations. This announcement constitutes the only solicitation. A WRITTEN SOLICITATION, i.e.; PAPER COPIES, OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis solicitation is being be posted at the FEDBIZOpps website at: www.fbo.gov. This solicitation is being issued as a Request for Quotation (RFQ) No. 45310019Q0065, and is in accordance with Federal Acquisition Regulation (FAR) Part 12.6, Acquisition of Commercial Items. This announcement is considered a sole source procurement. The North American Industry Classification System (NAICS) Code for this requirement is 511199. This solicitation document and incorporated provisions and clauses are those in effect through FAC 2019-02, effective May 6, 2019. The proposed contract action is for commercial supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR Part 12. The Equal Employment Opportunity Commission (EEOC) contemplates the award of a Firm-fixed price type contract to provide access to an On-line Enterprise-Wide Database Subscription Services to include items as stated in CLIN 0001 thru CLIN 0004 below. Period of Performance: The anticipated period of performance will be for a base period of eleven (11) months, commencing from September 1, 2019 through July 31, 2020. 508 Compliance: The contractor shall be in compliance with the Revised Section 508 requirements of the Rehabilitation Act of 1973 and W3C World Wide Web Consortium Web Content Accessibility Guidelines WCAG Level AA. Pursuant to this requirement, the contractor must provide an Accessibility Conformance Report (ACR) prepared in accordance with A. Instructions to Offerors and B. ICT Support and Services Technical Criteria as set forth in Paragraph II, 508 Compliance" to of the attached Additional Requirements to this solicitation (See Attachment II). The quotation package shall include the following databases: Provide Access to an online Enterprise-Wide Database Subscription services for Labor & Employment Practice Center on Bloomberg Law shall include: 1.Case Collection, including BCITE & NLRB Decisions; 2. Disabilities Law Cases Manual; 12. Fair Employment Law Cases & Manual; 13. Individual Employment Rights Law Cases & Manual; 14. Wages Hours and Leave Law Cases & Manual; 15. Affirmative Action Compliance Manual; 16. EEO Compliance Manual; 17. NLRB New Filing Finder; 18. Practice Tools; 19. Daily Labor Report; 20. Labor & Employment Law Treatises; 21. BNA Labor Plus; ad 22. Practical Guidance. The above database(s) shall be accessible to all users within EEOC and authorize access for up to 413 remote users. The following CLIN includes the above databases and is applicable to this procurement (Firm-Fixed Price): CLIN 0001 (Base period):* Provide Access to an on-line Enterprise-Wide Database Subscription Services for Labor and Law Practice Center, Quantity: eleven (11) months, Amount: $ ________. Period of Performance: From September 1, 2019 up through July 31, 2020. CLIN 0002 (Option Year 1): Provide Access to an On-line Bloomberg BNA Enterprise-Wide Database Subscription Services for Labor and Law Practice Center, Quantity: twelve (12) months, Amount: $ ________. Period of Performance: From August 1, 2020 up through July 31, 2021. CLIN 0003 (Option Year 2): Provide Access to an on-line Enterprise-Wide Database Subscription Services for Labor and Law Practice Center, Quantity: twelve (12) months, Amount: $ ________. Period of Performance: From August 1, 2021, up through July 31, 2022;.and CLIN 0004 (Option Year 3): Provide Access to an On-line Bloomberg BNA Enterprise-Wide Database Subscription Services for Labor and Law Practice Center, Quantity: twelve (12) months, Amount: $ ________., Period of Performance: From August 1, 2022, up through July 31, 2023 for all required services. *(NOTE: The term "period" used under CLIN 0001 refers to a base period of eleven in lieu of a twelve months. Each option period will be for a one-year period, i.e.;12months ( TOTAL COST TO THE GOVERNMENT (CLIN 0001 thru 0004), $______. FY 2019 funds are current available for the base period (11months). Funds for each Option Period are not currently available and will be subject to the availability of funds, if option(s) is exercised by the Government, when applicable. Supplemental Agreements: If the contractor requires supplemental agreements, those agreements should be submitted with the quotation. If the contractor requires signature of a supplemental agreement that was not submitted with the quotation, the quotation will be rejected. SUBMISSION OF QUOTATIONS: Quotations will only be accepted via email. Quotation submitted via Hand delivery, facsimile, Internet or any other electronic means (except email), or the U.S Postal Services WILL NOT BE ACCEPTED. Each Quotation in response to RFQ 45310019Q0065 must be received via email only, no later than Thursday, August 29,2019, by 10:00 a.m (Washington, DC local time). All responsible sources may submit a quotation which shall be considered by the EEOC. Basis for Award: The Government intends on negotiating solely with Bloomberg BNA as it is the sole provider of Bloomberg BNA Enterprise-Wide Database Subscription Services for Labor and Law Practice Center. For additional information the sole source justification (Revised) has been provided as an attachment to this solicitation (See Attachment I). The Government will evaluate the quoter's price for reasonableness. Award will be made to the responsible quoter whose quote conforms to this RFQ and a determination, prior to award, that the negotiated price is fair and reasonable, representing the best value to the Government. The anticipated contract award date is in September 2019. Price: Price will be evaluated against the independent Government estimate. Price Quotation shall be firm-fixed price and in accordance with the above CLIN Structure provided in this combined synopsis solicitation. The quoter must submit pricing for all Contract Line Items (CLIN Nos. 0001 thru 0004) to be considered for an award. Notice: The Government intends to evaluate quotation(s) and make award without discussions (except clarifications as described in FAR 15.306(a)), therefore, the quoter(s) initial quote should contain the quoter's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions, if the Contracting Officer later determines them to be necessary. System for Award Management Registration (SAM): In order to conduct business with the Government, quoters must register in the System for Award Management System database.
