SOLE SOURCE JUSTIFICATION FAR PART 13 SIMPLIFIED ACQUISITION PROCEDURES 1. Contracting Activity: Department of Veterans Affairs Office of Procurement, Acquisition and Logistics Strategic Acquisition Center Frederick 5202 Presidents Court Suite 103 Frederick, MD 21703 2. Description of Action: The proposed sole source contract is for a firm fixed price effort for Leasing Professionals Certification Level III training for the VA Acquisition Academy. 3. Description of Supplies or Services: The proposed action is to provide Classroom (face-to-face) training for financial analysis training for Leasing Certification Program Level III certification requirements, specifically the course Financial Analysis for Commercial Investment Real Estate. The total estimate value of the proposed action is [REDACTED], (below the Simplified Acquisition Threshold). 4. Statutory Authority: In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonable available. 5. Rationale Supporting Use of Authority Cited Above: The VA has been delegated Leasing warrant authority by GSA. All Lease warrant holders must meet GSA certification requirements to be issued and to maintain a lease warrant. GSA has established a crosswalk of training requirements by field of study, along with a list of organizations qualified and certified to provide training. On page 1 of the included GSA Level III Crosswalk (dated January 31, 2017), under the category of Leasing Training Options, GSA designated which vendor was an acceptable provider for the financial analysis learning objectives. Further details at the top of page 6 contain the equivalency options, showing that only one vendor could provide a training offering that would meet the minimum training hours that are required for Level III certification. Certified Commercial Investment Member Institute (CCIM) (a non-profit industry educational organization) is stated as the only qualified provider for the Financial Analysis for Commercial Investment Real Estate course, under the field of study area of Real Estate Finance and Marketing. The VAAA has been requested to provide specific training to support the Office of Real Property for Leasing Certification Professional Level III, with training that must be conducted by December 31, 2019. CCIM has been identified by GSA through market research and verified through the due diligence of the VAAA s extensive market research as the sole source for this specific required course. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Consistent with the guidelines of the Veterans Affairs Contracting Program, the proposed action described herein will be synopsized on the Federal Business Opportunities Page in accordance with FAR Part 5. 7. Actions to Increase Competition: All future requirements will be handled on a case-by-case basis to determine any future acquisition strategy. 8. Market Research: As GSA has established a crosswalk of training requirements along with a list of organizations qualified and certified to provide training, the Government performed market research to the extent necessary to determine that this is a sole-source requirement. 9. Other Facts: CCIM has over 50 years of experience in providing training for financial analysis in the realm of commercial real estate. Additionally, the designation of CCIM by GSA indicates this is the only certified/qualified provider for the Financial Analysis for Commercial Investment Real Estate course that will meet the needs of the Government.
