Description
1. Identification of the agency and the contracting activity, and specific identification of the document as a "Limited Source Justification." This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code CDC). 2. Nature and/or description of the action being approved. This action will award a firm fixed price purchase order to Semko, Ray Doing Business As (DBA) The DICE Man (DUNS: 830559485 / CAGE Code: 5GCF7), 322 Mcmullen Rd Altoona, PA, 16601 for customized Security Awareness training classes to promote NSWC PCD personnel security awareness. 3. A description of the supplies or services required to meet the agency's needs (including the estimated value). The contract effort is to acquire the following: Up to 8 training sessions of 2 hours each session with up to 225 personnel for each session to provide NSWC PCD personnel a comprehensive knowledge of • Numerous and potential threats to US national security • Top security concerns and new cases in the areas of espionage, economic espionage and terrorism. • Multiplicity and the interconnectedness of all the threats that constitute the country's biggest challenges • Methods of operations of the organization's adversaries • Greatest threats that confront NSWC PCD The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of for three sessions. The training will be conducted starting in July 2019 with an estimated completion date of 15 November 2019. The purchase will be funded with FY 2019 Navy Working Capital Funds (Overhead). 4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The Naval Surface Warfare Center Panama City Division (NSWC PCD) has a requirement to purchase commercially available training classes on the topic of Security Awareness based on the Defensive Information to Counter Everything (DICE) security awareness briefings. The goal of the class is to enhance NSWC PCD personnel knowledge of security threats, processes, and countermeasures. This requirement is not suitable for full and open competition for the following reasons. The DICE Man is the only source with the specialized knowledge and security expertise to design and deliver a course that meets NSWC PCD technical training needs taught by a highly experienced security professional able to provide hands-on, in- depth instruction, with specific application to the NSWC PCD workforce. The DICE Man has over 39 years of experience in DoD security policies, practices and procedures and has conducted security awareness briefing for organizations from Fortune 500 companies to U.S. DoD and Intelligence Agencies. The DICE Man has conducted previous briefings at NSWC PCD and has the ability to tailor the presentations specifically to NSWC PCD based on his knowledge of the NSWC PCD mission. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. This requirement will be synopsized on the Federal Business Opportunities (FEDBIZOPPS) website per FAR Part 5.2 as it is estimated at $40,000. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above to substitute any other training. 7. Any other facts supporting the justification: None 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, The DICE Man is the only source with the highly specialized knowledge and experience to design and deliver the required training.
