This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued. This solicitation is a request for quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2019-02 (05 JUN 2019). The associated North American Industrial Classification System (NAICS) code for this procurement is 333314, with a small business size standard of 500 employees. The VA Sierra Nevada Health Care System, VA Reno, 975 Kirman Ave, Reno, NV 89502, is seeking to procure a Lumenis laser platform. All interested companies shall provide quote for the following: COST/PRICE Schedule of Supplies Line Item Description Quantity Unit Price 0001 Lumenis Moses Pulse(tm)120H - Pulsed holmium laser at 2,100 nm at an operation range of 5 to 80 Hz, and 0.2-6.0 joules for a total power of up to 120 Watts. Fiberoptic port for urology, lithotripsy, gastroenterology, pulmonology, orthopedics, general surgery and other surgical procedures using fiber delivery systems. * Moses technology * Green aiming beam with adjustable intensity and blinking mode * Color touch screen with an advanced user interface to allows for easy adjustment of all laser settings and includes presets, reports and additional advanced functions. * Dual Foot Pedal capable of lasing in 2 predefined laser settings and a Ready/Standby toggle button * 2 spare Debris Shields (in the storage compartment at the back of the system) * 3 pair of safety glasses * Operator manual CD * Laser safety signage In-hospital laser training program for the O.R. nursing staff by a Lumenis Regional Education Manager (qualifies for up to 4.0 contact hours by ANA), must be used within 1 year of shipment. The contractor shall deliver all line item(s) to VA Sierra Nevada Health Care System, VA Reno, 975 Kirman Ave, Reno, NV 89502. Award shall be made to the quoter, whose quotation, offers the best value to the government. The government will evaluate information based on the following evaluation criteria: (1) meeting or exceeding the requirement, and (2) price. (b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor s compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor s offices where the Contractor s business records or other proprietary data are retained and to review such business records regarding the Contractor s compliance with this requirement. (c) All support contractors conducting this review on behalf of VA will be required to sign an Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement to ensure the Contractor s business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. (d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor s compliance with the limitations on subcontracting or percentage of work performance requirement. (End of Clause) The following provisions apply to this acquisition: FAR 52.214-21 Descriptive Literature (APR 2002) Alternate I (APR 2002) 52.212-3 Offeror Representations and Certifications Commercial Items (OCT 2018) Alternate I (OCT 2014) ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS COMMERCIAL ITEMS The following provisions are incorporated into 52.212-1 as an addendum to this solicitation: THE GOVERNMENT INTENDS TO MAKE AWARD BASED ON INITIAL QUOTES. ACCORDINGLY, VENDORS ARE ENCOURAGED TO SUBMIT THEIR INITIAL QUOTES BASED UPON MOST FAVORABLE TERMS, PRICES, TECHNICAL AND OTHER FACTORS. 1) Vendors shall provide a quote: (a) Completed Price-Cost Schedule accompanied by vendor quote. (b) Technical 2) Grey Market Prevention Language (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items. FAR 52.212-2, EVALUATION COMMERCIAL ITEMS (OCT 2014) (a) The Government will award an order resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1. Technical: The vendor s quote must contain all the required salient characteristics and exact match for the designated Lumenis laser system. A vendor must be determined technically acceptable in these factors in order to be considered for award. Technically acceptable is considered providing all required salient characteristics for the designated Lumenis laser system. The technical ratings are defined as follows: Acceptable: Quote clearly contains all the required salient characteristics and exact match for the designated Lumenis laser system and line item descriptions of the solicitation. Unacceptable: Quote does not clearly meet the salient characteristics and exact match and line item descriptions of the solicitation. 2. Price: The government will evaluate price by adding the total amount of all the requested items. Vendors are encouraged to submit their quotes with the most advantageous pricing and discounts. Award will be made on a Lowest-Priced, Technically Acceptable basis. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. All quotations shall be emailed to deborah.sosa@va.gov. This is an open-market combined synopsis/solicitation for a Lumenis laser System as defined herein. The government intends to award a purchase order because of this combined synopsis/solicitation that will include the terms and conditions set forth herein. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows: "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" Quoter shall list exception(s) and rationale for the exception(s). Submission shall be received not later than June 20, 2019, 12:00 p.m. Pacific Time. Emailed offers will be accepted. Late submissions shall be treated in accordance with the solicitation provision at FAR 52.212-1(f).
