Description
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 02). 2. Nature and/or description of the action being approved. This action will award a purchase order, on a brand name specific basis, to acquire OEM Overhaul Kits for Bauer compressors. These items are being acquired for the manufacture and overhaul of Emergency Breathing Air Compressors assemblies for NAVSUP. 3. A description of the supplies or services required to meet the agency's needs (including the estimated value). Items Part Number Qty KIT-NSWC/C/DV/NAVY 86 ea KIT-NSWC/OCEANUS 4 ea This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. The contract action will be funded with 2019 Navy Working Capital Funds (NWCF). 4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. Only BAUER Parts can be used in BAUER compressors. Extensive testing has been conducted on aftermarket parts and have proven to be inferior to OEM. BAUER Company is a global developer and provider of high-quality and reliable fluid system solutions including products, assemblies and services for the research, instrumentation, process, oil and gas, power, petrochemical, alternative fuels, and semiconductor industries. Using alternate equipment would prove costly in time and dollars to the Government and to the mission by having overhauls compressors at shorter intervals due to inferior internal parts being used. Additionally, use of alternative components may change or introduce new parameters that may be harmful to the user of the compressor. Therefore, it is imperative that BAUER brand of equipment is purchased. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. The dollar amount of this procurement does not require a synopsis. Acquisition of components will be facilitated through the use of Simplified Acquisition Procedures (SAP) to meet stringent U.S. Navy scheduling requirements. 7. Any other facts supporting the justification. During testing of aftermarket parts relief valves have inadvertently popped due to poor casting and machining leading to compressor inefficiency. Reduction in efficiency reduces emergency reaction time to combat shipboard casualties. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, the BAUER brand, is the only brand that can meet this requirement.
