Description

Notice of Intent to Negotiate and Award a Sole Source Contract to Schindler Elevator Corporation for Operation, Maintenance and Repair of Schindler Elevators in the U.S. Nuclear Regulatory Commission's Two White Flint North Building (TWFN). The U.S. Nuclear Regulatory Commission (NRC) intends to solicit, negotiate and award a noncompetitive contract with Schindler Elevator Corporation for the operation, maintenance and repair of NRC's proprietary Schindler Miconic TRX5 w/VF88 Power Factor One Drive elevators in the NRC's Two White Flint North (TWFN) Building, 11545 Rockville Pike, Rockville, MD 20852-2738. The period of performance will consist of a base period of one year, beginning on May 6, 2019, plus four one-year options to extend the term of the contract. The NRC recently received written confirmation from Schindler Elevator Corporation, dated 3/06/2019, that revealed that Schindler Elevator Corporation is the only source that can provide the required Operation, Maintenance and Repair for the proprietary Schindler elevator systems that are installed and operating in the NRC's TWFN Building, as the software provided in the equipment is proprietary to Schindler and Schindler solely owns the proprietary tools to service and diagnose the equipment. The authority to noncompetitively enter into a contract with Schindler Elevator Corporation is 41 U.S. C. 253(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1. FAR 6.302-1 authorizes restricting competition in those situations where the supplies or services are available from only one responsible source and no other supplies or services will satisfy the agency requirements.
