The government will evaluate information based on the following evaluation criteria: Technical: Meeting or exceeding Salient Characteristics and Price.     The Vendor shall provide one (1) complete Stereotaxic System which meets the requirements listed above and below. Delivery on or before May 1, 2019. 3.0 Additional Equipment Requirements: 3.1 Specifications of component equipment as set forth in this section are minimum specifications, unless otherwise stated, and shall not be construed as limiting the overall quality, quantity or performance characteristics of items furnished in the system. 3.2 All equipment to be supplied under this specification shall be new and the current model of a standard product of a manufacturer of record. A manufacturer of record shall be defined as a company whose main occupation is the manufacturer for sale of the items of equipment/ products and which: 3.2.1 Maintains a factory production line for those items 3.2.2 Maintains a stock of replacement parts for the item 3.2.3 Maintains engineering drawings, specifications, operating manuals and maintenance manuals 3.2.4 Has published and distributed descriptive literature and equipment specifications on the equipment HOURS OF OPERATION 4.1 Normal hours of operation are Monday through Friday from 8:00 am to 4:30 pm, excluding holidays. All service and repairs must be performed during normal work hours of coverage, unless otherwise requested by the Contractor and/or approved by the Contracting Officer Representative (COR) or his/her authorized designee. 5.0 PRODUCT MODIFICATION, REMOVAL OR RECALL: 5.1 If any product awarded under this solicitation requires modification, is removed or recalled by the Contractor or manufacturer, or if any required modification, removal, or recall is suggested or mandated by a regulatory or official agency, the following steps will immediately be taken by the Contractor or Manufacturer: 5.1.1 Notify the Contracting Officer, in writing, by the most expeditious manner possible. Provide two copies of the notification which shall include, but not be limited to the following: 5.1.1.1 Complete item description and/or identification, order numbers from customers and the contract number assigned as a result of an award on this solicitation. 5.1.1.2 Reasons for modifications, removal, or recall. 5.1.1.3 Necessary instructions for return for credit, replacement, or corrective action. 5.1.2 Contractor / Manufacturer shall be responsible for any costs associated with the above. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
