Description

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a separate written solicitation will not be issued. This solicitation number is NICHD-19-025a and is issued as a Request for Quotation (RFQ). The solicitation/contract will include all applicable provisions and clauses in effect through Federal Acquisition Circular 2019-03. The North American Industry Classification (NAICS) Code is 8112119 and the business size standard is $20.5m. However, this solicitation is not set aside for small business. This acquisition is being conducted using Simplified Acquisition Procedures in accordance with FAR Part 13. Eunice Kennedy Shriver National Institute of Child Health and Human Development (NICHD) intend to procure on a sole source basis with Nikon Instruments - 1300 Walt Whitman Road - Melville, NY 11747o procure a fixed priced Base Plus two Options period service agreement (Base Year period of performance (POP) April 1, 2019 - December 31, 2019, 1st option period POP Jan 1, 2020 through December 31, 2020 and the 2nd option period POP, Jan 1, 2021 through December 31, 2021) for the following Nikon manufactured instrument as well as current software, etc. : A1R MP SCANNER S/N 40540 AND MP COMPONENTS LU-N4 LASER FIXTURE - SN 40652 LU Controller - SN 455581 Detector Unit - SN 59511 and NIS Elements Software Updates/Customizing 1 Preventative Maintenance (PM) Service per year Service to include: • Exceptional service and support by certified Nikon Biosystem Service Specialists who provide PM and system optimization to Nikon Specifications • Maximization of up-time, minimization of system failure and repair expenses • Free consultation w/authorized Nikon technical experts via web or phone to reduce system downtime • Covers part, labor and travel Nikon Instruments is the sole manufacturer, sole provider, and licensed distributor of the requested Nikon items and service being referenced in this solicitation. Nikon Instruments has exclusive rights and holds the patents on the Nikon A1R MP scanner, Nikon LN-U4 laser fixture, and Nikon NIS-Elements software and its upgrades. The Nikon A1R MP scanner can only be serviced for repair through Nikon Instruments Inc. and/or a Nikon Instruments authorized service provider. Only Nikon Instruments Service Department is authorized to perform these services and have access to original equipment manufacturer (OEM) parts, software updates, supplies, etc. The maintenance service plan for the Nikon A1R MP scanner listed in this solicitation is highly specialized and does not allow other businesses as authorized dealers, distributors, or resellers of these products and maintenance services. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of the 41 U.S.C. 253(c) (1), FAR 6.302. Only one responsible source and no other supplies or services will satisfy agency requirements. The offeror must include a completed copy of the provision of FAR Clause 52.212-3, Offeror Representations and Certifications - Commercial Items with its offer. The provisions of FAR Clause 52.212-1 Instructions to Offerors - Commercial Items; FAR Clause 52.212-2, Evaluation - Commercial Items; FAR Clause 52.212-4, Contract Terms and Conditions - Commercial Items; and FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items - Deviation for Simplified Acquisitions applies to this acquisition. The offeror must include their Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. Responses to this solicitation must include sufficient information to establish capability to provide all products specified in this synopsis and should submit a copy of their quotation/offer to the below address or via email to robinsti@mail.nih.gov. Offers must also be accompanied by descriptive literature, delivery timeframe, warranties and/or other information that demonstrates that the offer meets all the foregoing requirements. Quotations will be due sixteen calendar days from the publication date of this synopsis or by February 12, 2019 by 8 am, EST. via email or postal mail.
