- Dear Industry Partner, This notice is issued by the Chief Procurement Officer (CPO)/Senior Procurement Executive (SPE) of the Department of Homeland Security (DHS) to address inquiries received. Since December 22, 2018, there has been a lapse in appropriations to fund the Department. Given the lapse in funding, there are significant limitations as to the number of employees and the type of work that may continue to be performed in a lapse status. Until funds are appropriated to reopen DHS, business is limited. This notice applies to all Requests for Information, Requests for Proposals/Quotations or other solicitations issued by DHS on or before December 21, 2018 for which an amendment has not been issued by the Contracting Officer to establish the schedule for submission of responses or offers based on the lapse in funding. To ensure all Offerors receive equivalent time for responding to these solicitations, the CPO/SPE is establishing the minimum response timeframes set forth below for the following DHS procurement organizations. (e.g. 70B04C19R00000419) Customs and Border Protection (CBP) - Contracting Office Identifier: 70B Federal Law Enforcement Training Center (FLETC) - Contracting Office Identifier: 70L Immigration and Customs Enforcement (ICE) - Contracting Office Identifier: 70C Office of Procurement Operations (OPO) - Contracting Office Identifier: 70R Transportation Security Administration (TSA) - Contracting Office Identifier: 70T U. S. Coast Guard (USCG) - Contracting Office Identifier: 70Z U. S. Secret Service (USSS) - Contracting Office Identifier: 70U Please note that this notice does not apply to Federal Emergency Management Agency (FEMA), United States Citizenship and Immigration Services (USCIS) and Federal Protective Services (FPS) contracting and procurement actions. Requests for Information (RFIs): For the purposes of this announcement, RFIs include requests for review and comment on draft RFPs, RFQs, or other documents. Interested parties shall submit their response to all RFIs within three (3) business days following resolution of the DHS funding lapse and resumption of business operations. Responses shall be submitted in the form and format and to the locations and addresses identified in the RFI. Requests for Proposals (RFPs) and Requests for Quotations (RFQs): If the particular RFP or RFQ provided for the submission of questions, comments or other forms of inquiry after December 21, 2018 and the DHS funding lapse is not resolved prior to the deadline established in the RFP for this type of submission, then the submission shall be due within five (5) business days following resolution of the DHS funding lapse and resumption of business operations. Responses (i.e., questions comments or other inquiry) shall be submitted in the form and format and to the locations and addresses identified in the RFP or RFQ. Submission of Offers in Response to RFPs and RFQs: If the particular RFP or RFQ established a deadline for submission of a proposal or quotation after December 21, 2018 and the DHS funding lapse is not resolved prior to the deadline established in the RFP, then the proposal or quotations shall be due within seven (7) business days following the resolution of the DHS funding lapse. The hour of submission shall remain as specified in the RFP or RFQ. Proposals or quotations shall be submitted at the time of day specified, in the form and format requested and to the locations and addresses specified in the RFP or RFQ. DHS intends for the Contracting Officer to prepare and issue formal amendments to solicitations upon the conclusion of the funding lapse. However, in the absence of specific written guidance issued by the Contracting Officer for the particular RFI, RFP or RFQ, the deadlines set forth above shall apply. If an Offeror has already responded to a solicitation described above and would like to update their submission they may do so in accordance with the schedule set forth above as may be further amended by the Contracting Officer. Any updated submission shall be appropriately notated to indicate it is in accordance with the schedule set forth in this FBO notice.
