Description
Justification for Other Than Full and Open Competition, Lease extension U.S. General Services Administration GSA Region 4 Georgia Leasing Branch JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION PROJECT NUMBER: 8GA2325 Agency Name: Department of Homeland Security - Office of Inspector General (DHS/OIG) 1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED. The General Services Administration currently leases 12,538 ABOA/14,795 rentable square feet (RSF) of office space at 10 10th Street NE, Atlanta, Georgia under lease number GS-04B-45070 for the Department of Homeland Security - Office of Inspector General (DHS/OIG). The current lease expires August 31, 2018. While the long-term replacement lease has been awarded through a competitive procurement, this 8-month extension will allow time to complete the design and buildout of the agency's new space. Approval is requested to negotiate an extension with the incumbent Lessor without full and open competition for continued occupancy at this leased location to prevent a disruption in the agency's mission during the completion of the buildout of their new space. The right to pursue an extension is detailed in GSAR 570.405: Lease Extensions. 2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS (INCLUDING ESTIMATED VALUE). Department of Homeland Security - Office of Inspector General (DHS/OIG) submitted a continuing need letter on March 28, 2018 for 14,795 rentable square feet of office and related space. To satisfy the Department of Homeland Security - Office of Inspector General (DHS/OIG) mission requirements, the facility must be ready for immediate usage. This requirement is for 12,538 ABOA/14,795RSF of space for an eight-month term to commence on September 1, 2018. The estimated cost of this lease extension is $52 per rentable square feet per year for an annual cost of $769,340.00 and a total contract value of $6,398,699.00. The delineated area is Midtown Atlanta, Georgia (as pictured below). 3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. 41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. In accordance with FAR 6.302-1 and GSAR 570.405, it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition. 4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation of the entire requirement and would cause Department of Homeland Security - Office of Inspector General (DHS/OIG) to incur move and replication costs that would not be recovered through competition. Relocation costs are estimated to be $95,632.00. Additionally, this allows the Government to make use of existing tenant improvements, avoiding replication costs of $452,110.00. Specific requirements such as sound masking, security systems, ballistics, electric strikes, video teleconference wiring, bulletproofing, ventilation, weapons storage, fire suppression, CCTV, and DHS seals would all need to be replicated. A cost-benefit analysis was completed following the procedures set forth in GSAR 570.402-6 and is attached to this justification. The cost of relocating Department of Homeland Security - Office of Inspector General (DHS/OIG) using the low cost quote exceeds the cost of remaining at 10 10th Street NE, Atlanta, Georgia. The total savings to the Government is $351,092.00. 5.DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM ASMANY POTENTIAL SOURCES AS IS PRACTICABLE. Per the requirements of GSAR 570.402, the GSA Lease Contracting Officer placed an advertisement on FedBizOpps (FBO) on April 5, 2018 for 30 days. 6.DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TOTHE GOVERNMENT WILL BE FAIR AND REASONABLE. On May 15, 2018 GSA conducted market research utilizing CoStar and identified 20 comparable buildings within the delineated area of Midtown Atlanta. The properties listed could not meet the agency's space requirement or did not show interest due to the short term of the extension. The properties outlined below will establish a rental range for comparable Class A space. This was determined to be between $25.00 to $44.50 psf fully serviced. Source 7.DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS. DHS - OIG has occupied the above-referenced space under Lease No. GS-04B-LGA45070 since August 2006. The incumbent Lessor, UIR 10TH STREET LLC is responsive and is meeting and performing all the requirements of the current lease. This request for a one-time extension will not include an increase in square footage. There are no existing fire and life safety deficiencies. It is in the best interest of the Government to enter into negotiations with the current Lessor for the addition of a one-time extension at the existing location. The current location is immediately available and is already constructed to meet the agency's needs without disruption. This procurement strategy will ensure the Government will meet the agency's housing requirements. If other space was leased for a short term, the Government would incur build-out and relocation costs which would be unrecoverable during such a short term. See Figure 1 below for the results of the market research and FBO advertisement, including the incumbent. The past performance of the lessor has met GSA expectations. The long-term replacement lease has been awarded, currently in the design and buildout phase. Full and open competition was utilized through the Automated Advanced Acquisition Program. 11.CONTRACTING OFFICER CERTIFICATION.
