- The purpose of this amendment to the solicitation is to 1) revise the language found on page 2, paragraph 4 and 2) address questions from prospective vendors. 1) The language on page 2, Price Schedule section, paragraph 4, will change from, The guaranteed minimum award for this contract is $500.00 The maximum aggregate value of orders that can be placed under this contract is $550,000.00. To, The guaranteed minimum award for this contract is $500.00 The maximum aggregate value of orders that can be placed under this contract is $3,550,000.00. 2) Question 1. Clause 52.222-41 is typically present when a contract will have Service Contract Act (SCA) covered personnel whose Wage and H&W is determined and periodically adjusted by Wage Determinations (WD) published by the DOL. This clause is normally supplemented with the current WD (Government has offer WD) signaling to bidders that SCA is part of this contract. Will the Government confirm that SCA is part of this contract and add clause 52.222-41 to the RFP? Answer 1. All the appropriate clauses regarding the Service Contract Act and other Department of Labor regulations are already included in the RFQ under 52.212-5. Question 2. Will the Government incorporate FAR 15.222-43 - Fair Labor Standards Act and Service Contract Labor Standards - Price Adjustment (Multiple Year and Option Contracts) or 15.222-44 Fair Labor Standards Act and Service Contract Labor Standards - Price Adjustment depending upon your timing preference for allowing DOL WD cost adjustments for the SCA personnel? Answer 2. See answer 1. Question 3. Will the Government incorporate FAR 52.222-62 - Paid Sick Leave Under Executive Order 13706 requiring up to 56.00 hours of Sick leave to accrue per year for any SCA and Exempt personnel? Answer 3. See answer 1. Question 4. Will the Government incorporate FAR 52.222-17 Non-displacement of Qualified Workers requiring first right of refusal for SCA covered incumbent personnel? Answer 4. See answer 1. Question 5. We have noticed the Acreage, Headstone, and Marker Counts for each option year are equal to the base year. It is customary to see an increase in headstone count and markers and sometimes Acreage for Improved Grounds as new phases are opened up or improved grounds are expanded. Should any of these values rise by a certain number or percentage, or is the Government anticipating the awardee to pursue equitable adjustments as additional Acreage, Headstones, and Markers are added throughout the life of the contract? Answer 5. In accordance with FAR 52.212-4 Contract Terms and Conditions Commercial Items, (c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties. Question 6. We have noticed there is not a defined separation in work to be performed for non-growing season (i.e. CLIN 0001 requires 36 cuts year without defining exactly when those should occur though elsewhere it states that the grass should be cut weekly during the growing season). It is customary to have defined Growing and Off-Season work requirements separated by CLIN. Is the awardee not to perform any mowing, trimming, edging services in the off season and if so, please define those months that require no services or what minimum services are required? Answer 6. The services required under this contract are directly affected by the weather and geographic location of the cemetery therefore, there is not an off-season. Services will be requested in accordance with the ordering instructions and information provided in the RFQ and Performance Work Statement. Question 7: Can the Government offer a 2-3 business day extension to allow offerors to incorporate any CLIN, Clause, SCA Cost changes impacting current cost models based upon responses to these and any other outstanding questions? Answer 7: No extension to the solicitation closing date will be provided at this time.
