Description
PLEASE READ THIS ENTIRE NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE ISSUED This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in the notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Request for Quotation (RFQ) number is N66604-19-Q-0179. The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) has a requirement to purchase the following one (1) year software licenses for HyperWorks from Altair Engineering, Inc., Troy, MI ("Altair") on a sole source basis as the software and associated software maintenance are proprietary to Altair. Altair Engineering Inc. is the sole owner and developer of this proprietary software including maintenance and support. The continued use of this software is needed to support the design, structural and acoustical analysis of existing prototype weapon systems, and undersea vehicles. These tools are provided in a distributed server/client environment making them accessible throughout NUWCDIVNPT to various Science & Technology (S&T) groups. Altair is the only source that supplies all the required meshing, viewing, graphing, and cluster control software in the existing perpetual licenses needed for this requirement. Any attempt at replacing the product with a similar product would require excessive costs to include but not limited to: procuring licenses for another software tool, training the engineers in the new software tool; converting the current models to the new tool; transitioning to a new scheduler, which would require a tasking effort to include market research; feasibility studies; system administrator training; additional software procurement; software installation/configuration; customization; and user training. CLIN 0001 - HyperWorks Units - maint; HWU-STD-MNT, 1 Year CLIN 0002 - HyperWorks Units - maint; HWU-STD-MNT, 1 Year This requirement is being solicited as an unrestricted, sole source requirement under North American Industry Classification System (NAICS) Code 511210, as concurred with by the NUWCDIVNPT Office of Small Business Programs (OSBP). The small Business Size Standard is $38.5M. The Period of Performance is 01 November 2018 through 31 October 2019. F.O.B. Destination, NUWCDIVNPT, Newport, RI 20841. Payment will be made via Wide Area Work Flow. The resultant contract will be a Firm Fixed Price purchase order. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005- 95. The provision at FAR 52.209-11, Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction, 52.212-1, Instructions to Offerors - Commercial Items applies to this solicitation. The provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items applies to this solicitation. FAR clauses 52.212-4, Contract Terms and Conditions - Commercial Items, and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items apply to this solicitation. DFARS 252.204-7008, Compliance with Safeguarding Covered Defense Information Controls, 252.204-7009, Limitations on the use of Disclosure of Third-Party Contractor Reported Cyber Incident Information and 252-204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting apply to this solicitation. The following addenda or additional terms and conditions apply: Defense Priorities and Allocations System (DPAS) rating DO-C9 applies.
