Description
The purpose of this Amendment is to answer Vendor submitted questions. QUESTION 1: Will a 12L water bath be acceptable for the application, instead of the called for 10L water bath? ANSWER: YES QUESTION 2: Will a 18L water bath be acceptable for the application, instead of the called for 20L water bath? ANSWER: YES QUESTION 3: Will a 26L water bath be acceptable for the application, instead of the called for 28L water bath? ANSWER: YES QUESTION 4: We are a VOSB trying to understand how the rule of two is applied in solicitations. Would you be willing to clarify something about your response below? The Rule of Two analysis showed that there are not enough interested SDVOSB/VOSB or SB manufacturers that responded to our RFI that could fulfill this requirement, and that there are not enough interested SDVOSB/VOSB distributors that have compatible products from two or more SB original equipment manufacturers capable of meeting the requirement, How does the determination that lack of SDVOSB/VOSB manufacturers able to fulfill the requirement satisfy the rule of two? From what I m able to find about this rule, there is no distinction between manufacturers and suppliers. 38 U.S.C. 8127(d) states that a contracting officer of the VA, shall award contracts on the basis of competition restricted to small business concerns owned and controlled by veterans if the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers and that the award can be made at a fair and reasonable price that offers best value to the United States. ANSWER: Absent a non-manufacture waiver, when a solicitation is set-aside for a SDVOSB or VOSB concern the requirements of VAAR Clause 852.219-10  VA Notice of Total Service-Disabled Veteran-Owned Small Business Set-Aside or 852.219-11 VA Notice of Total Veteran-Owned Small Business Set-Aside must be met.   These clauses require that any concern submitting a bid or offer in its own name, other than on a construction or service contract, that proposes to furnish an end product it did not manufacture (a nonmanufacturer ), is a small business if it has no more than 500 employees, and furnishes in the performance of the contract, the product of a small business manufacturer. The end product furnished must be manufactured or produced in the United States or its outlying areas. The term nonmanufacturer includes a concern that can, but elects not to, manufacture or produce the end product for the specific acquisition. For size determination purposes, there can be only one manufacturer of the end product being acquired. The manufacturer of the end product being acquired is the concern that, with its own forces, transforms inorganic or organic substances including raw materials and/or miscellaneous parts or components into the end product.
