Description
This is an update to the synopsis entitled Program Analysis and Control (PAAC) V 80GSFC18R0060 which was originally posted September 21, 2018. As a result of inquiries received in response to above synopsis, the following information is hereby provided to potential PAAC V Offerors. The PAAC V solicitation will not require Offerors to submit its mission suitability proposal in the form of an Oral Technical Proposal presentation. Written proposals will need to be submitted in accordance with the PAAC V mission suitability proposal instructions. Additionally, the resulting PAAC V contract will include an Organizational Conflict of Interest (OCI) clause that will place firmed restrictions on a company's ability to pursue additional NASA work. The Contracting Officer has determined that this acquisition may give rise to a potential organizational conflict of interest. Accordingly, prospective Offerors are directed to FAR Subpart 9.5 - Organizational Conflicts of Interest. The restrictions upon future contracting are as follows: (1) If the Contractor, through the performance of task orders issued under this contract, is required to develop specifications or statements of work that are to be incorporated into a solicitation, the Contractor shall be ineligible to perform the work described in that solicitation as a prime or any subcontractor under an ensuing NASA contract. This restriction shall remain in effect for a reasonable time, as agreed to by the Contracting Officer and the Contractor, sufficient to avoid unfair competitive advantage or potential bias (this time shall in no case be less than the duration of the initial production contract). NASA shall not unilaterally require the Contractor to prepare such specifications or statements of work under this contract. (2) To the extent work under this contract requires access to Government's and other contractor's "sensitive information" as defined in NFS 1852.237-72 Access to Sensitive Information. This also includes a vendor's proprietary, business confidential, or financial data; and/or may have access to Data and Information Technology (IT) systems, which may contain "sensitive information" as defined above, and as long as these data remain proprietary or confidential, the Contractor shall protect these data from unauthorized use and disclosure and agrees not to use them to compete with those other companies. Furthermore, during the term of the contract, Contractor personnel with access to "sensitive information" as defined in NFS 1852.237-72 Access to Sensitive Information; and/or may have access to Data and Information Technology (IT) systems, which may contain "sensitive information" as defined above, shall be prohibited from engaging in any marketing, consulting or advisory activities, business development, proposal preparation, or capture team that was formed for the purpose, of obtaining additional NASA work under existing contracts or new procurement opportunities. Prior to submitting an offer on any NASA solicitation, the Contractor shall provide a written certification to the Contracting Officer that no Contractor personnel with access to "sensitive information" as defined in NFS 1852.237-72 Access to Sensitive Information; and/or may have access to Data and Information Technology (IT) systems, which may contain "sensitive information" as defined above, under this contract participated on the marketing, consulting or advisory activities, business development, proposal preparation, or capture team that was formed to prepare the offer. The Contractor will be required to develop and implement a comprehensive OCI plan that includes training, execution of nondisclosure agreements, internal corporate firewalls, and oversight to protect against the disclosure of information or data obtained under this contract to other contractor employees that do not perform work on this contract. NASA/GSFC also restates that potential Offerors shall possess a Secret level facility security clearance by the due date for receipt of proposals. No Offeror will be considered for award who does not have a Secret level facility security clearance in place by the due date for receipt of proposals. For proposals submitted as joint ventures, the facility clearance must be granted in the name of the joint venture and the joint venture CAGE code shall be provided.
