- This is a post-award notice and a notice of a Limited Source Justification. Award was made on 9/25/18 to Jack Faucett Associates, Inc. for a Firm-Fixed-Price total of $1,344,082.36 as a Sole Source GSA Follow-on Task Order (#693JJ618F000134) for the continuation of the nation-wide disparity study in the rail industry previously done under GSA Task Order #DTFRf5314F00752. Limited Sources Justification GSA Task Order Exceeding the Simplified Acquisition Threshold •1.) This acquisition is conducted under the Multiple-Award Schedule Program. The schedule number for this procurement is GS-10F-0145K. •2.) The following information is required by FAR 8.405-6(c)(2): • I. This is a Limited Sources Justification completed by the Office of Acquisition Services at the Federal Railroad Administration (FRA). • II. This is a sole source in accordance with FAR 8.405-6(a)(1)(i)(C), "In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures." This action is a sole source follow-on GSA Task Order award to Jack Faucett Associates, Inc., for the continuation of the nation-wide disparity study for small and disadvantaged businesses in the rail Industry. • III. The FRA's Office of Civil Rights (OCR) is part of the Office of the Administrator and is responsible for equal opportunity programs. As part of these responsibilities, OCR requires a contractor to complete the nation-wide disparity study for small and disadvantaged businesses in the rail industry undertaken under the previous GSA Task Order # DTFR5314F00752, including the addition of 2015, 2016 and 2017 data and required Office of Management and Budget (OMB) data collection clearances. The previous task order was competed on GSA eBuy in April 2014 under RFQ # RFQ860013, and the Task Order was awared to Jack Faucett Associates, Inc. This is a sole source follow-on to Jack Faucett Associates, Inc. The current Task Order (# 693JJ618F000134) was awarded on 9/25/18 as a Firm-Fixed-Price order for $1,344,082.36. • IV. The authority for this action is FAR 8.405-6(a)(1)(i)(C). With a new contractor, FRA would be starting over and would not benefit from any of the analysis or knowledge gained by Jack Faucett Associates and its subcontractor related to work completed under the prior Task Order. The previous work was not able to be finalized due to delays resulting from OMB clearances related to the Paperwork Reduction Act. The vendor, Jack Faucett Associates, is a veteran-owned small business. It is more efficient and economical to do this as a GSA follow-on task order given the amount already spent (close to $2.8 million) on the first task order that would have to be redone by a new contractor if this requirement were to be opened up to further competition. The current requirement is for the following: •· Completing the OMB clearance submittals •· Completing the Disadvantaged Business Enterprise study adding the current contract data years. • V. The order reflects the best value to the FRA. The Firm-Fixed-Price is derived from estimated hours and labor rates established and approved by GSA under the Federal Supply Schedules program. The technical evaluators also determined the work proposed and the corresponding fixed price to be reasonable. • VI. Market research was done prior to the issuance of the original task order which was competed under GSA eBuy. • VII. There are no other facts supporting this justification. • VIII. There were no barriers that restricted consideration for this action. • IX. The contracting officer certifies below that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. • X. The technical personnel have provided a written determination that the new work is a logical follow-on to an original Federal Supply Schedule order.
