- 405-145 (MRSD/PRO) JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Pursuant to the requirements of the Competition in Contracting Act (CICA), as Implemented by FAR Subpart 6.301 Policy, (a) 41 U.S.C.,3304 and in accordance with the requirements of FAR 6.302-1, Only one responsible source and no other supplies or service will satisfy the agency requirements, (a) Authority. (1) Citations: 41 U.S.C 3304(a)(1), the justification for the use of the statutory authority under FAR Subpart 6.303 Justification is justified by the following facts and rationale required under FAR 6.303-1, Requirement, as follows: 1. Agency and Contracting Activity. The Department of Homeland Security, Office of Artesia Operations, proposes to enter into a contract on a basis other than full and Open competition for Service to the Automated Logic (ALC) system. Funding available in 19ART9003. 2. Nature and/or description of the action being approved. Federal Law Enforcement Training Center, Artesia, New Mexico has a customized professional maintenance requirement for a responsible source to have available technical support for our building automated system, Automated Logic WebCTRL program. The vendor for this service is: PC Automated Control Inc., 12279 Goodyear, EL Paso Texas, 79924. PC Automated Controls, Inc., is an authorized regional dealership for Automated Logic WebCTRL, and provides services the Southeast section of New Mexico and El Paso TX. 3. Description of Supplies/Services: The customized professional maintenance program will provide a minimum of two service visits annually provide maintenance service for building environmental mechanical system and energy metering in several building at the Federal Law Enforcement Training Center, Artesia, New Mexico, also will provide support monitoring, service and maintenance on our DDC control system Automated Logic WebCTRL. 4. Identification of Statutory Authority Permitting Items Peculiar to One Manufacturer. The statutory authority permitting other than full and open competition is 41 USC 253(c)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements 5. Demonstration That the Nature of the Acquisition Require Use of the Authority Cited. The Automated Logic System existing requires annual service and maintenance for the optimal performance of the systems operation. PC Automated Controls Inc. dealership is an authorized dealership in the Southwest section of the United State, and is authorized to perform services for the system which was purchased from Automated Logic. PC Automated is in a driving radius of 250 miles and is the prime dealership in the region to perform the required service and maintenance. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Automated Logic is a national corporation, whose dealers have established areas throughout the United States; Artesia NM is in the area serviced by El Paso TX dealer. At this time efforts to solicit from other vendor is not reasonable, because vendors must be authorized to work on the Automated Logic Systems. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. The cost presented is deemed fair and reasonable based on the vendor utilizing is labor rates already included in the open market on its GSA schedule. The total cost of this purchase includes the cost of equipment plus the previously established rate. No concerns exist and the vendor proposed price is deemed fair and reasonable. 8. Description of Market Research. Market research was done via calling other vendors of this product, as well as extensive research on the internet for companies providing these services and/or products. After finding out that no other vendor can install or provide these services it is deemed to be in the best interest of the government to purchase these items through PC Automated. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition. None. 10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the Acquisition. None 11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required. There are none at this time. 12. Contracting Officer's Certification. I certify that the data supporting the recommended use of items particular to one manufacturer is accurate and complete to the best of my knowledge and belief.
